Ordinance 2010-012 <br /> 1. To ensure that any park, open space, recreational areas, common <br /> areas and the like that are proposed to be owned and maintained by a <br /> homeowners' association, business improvement district, or other <br /> similar association are properly maintained for their approved uses, the <br /> City Council may require that the applicant execute and grant to the <br /> City easements and covenants over such areas within sixty (60) days <br /> after the City Council has made such requirements. <br /> 2. If the applicant fails to execute the open space easements and <br /> covenants and to file the same with the administrator by the expiration <br /> of the sixty (60) day period, the PUD Permit, Final.Plat, if any and <br /> Final Plan shall be deemed to be void, nullified and revoked unless an <br /> extension has been required in writing by the applicant and for good <br /> cause granted by the City Council. <br /> 1320.14 Planned Unit Development (PUD) Overlay District. <br /> Subd. I General Purpose. The Planned Unit Development (PUD) District <br /> promotes the development of land in a unified manner by treating the entire <br /> development as a single entity and relaxing the strict application of standard zoning <br /> and subdivision requirements, in exchange for a project that better forwards the goals <br /> and purpose of the City's Comprehensive Plan. The purpose of the PUD process is to <br /> achieve a higher quality, better project than would otherwise be possible if the strict <br /> application of the zoning and subdivision requirements were met. While PUD's may <br /> be allowed in any district, they are required for some types of development in certain <br /> districts. <br /> Subd. 2 Applicability. The PUD District is an overlay zoning technique, whereby <br /> the basic underlying zoning district establishes the basic allowable uses and the <br /> general standards for development and the approved PUD plan establishes the <br /> specific regulations for development and shall govern and take precedence over the <br /> underlying Zoning District regulations. If a zoning change is required to <br /> accommodate the uses or general intensity of development in the PUD, an application <br /> for a Zoning District change shall be made concurrently with the PUD application <br /> and, if approved, the Zoning Map shall be changed both as to the underlying zoning <br /> district and designation as a PUD district. <br /> Subd.3 General Procedure. <br /> A. Applicant shall meet with City Staff to clarify and determine PUD <br /> requirements and discuss applicant's development concept. <br /> B.
