Dacumenfa�ion <br />"Written documentation of the �ndings and reasons why an interior znspection was not <br />conducted mvst be made and retained under section 469.175, subdivision 3{1)." <br />Qualification Requirements <br />Minnesota Statutes, Section 469.174, Subdivision 10 (a) (1) requires two tests for occupied <br />parcels: <br />A. Coverage Test <br />..."parcels consisting a� 70 percent af the area of the district are occupied by buildings, <br />streets, utilities, or paved or gravel �arking lots" <br />The coverage required by the parcel to be considered occupied is de�ned under <br />Minnesota Statutes, Section 469.I74, 5ubdivision .10(e}, which states: "For purposes oi <br />this subdivision, a parcel is not occupied by buildings, streets, utilities, or paved or gravel <br />parl�ing Iots unIess I5 percent of the area of the parcel contains building, streets, utilities, <br />or paved or graveI parking lats." <br />B. Condition of Bui[dings Test <br />..."and 20 percent of the buildings are structurally substandard; and 30 percent of the <br />oth�r buildings require substantial renovation or clearance to retnove existing conditions <br />such as: inadequate street (ayo�t, incompatible uses or Iand use reIa�ianships, <br />overcrowding of buildings on the land, excessive dwelling unit density, obsolete <br />buildings not suitable for improvezx�.ent or conversion, or other identified hazards to the <br />health, safety, and general well-being of the community." <br />Siructurally substandard is defined under Minnesota Slatutes, Section 469.174, <br />Suhdivision 10(h), which states: "For purposes of this subdivision, `structuraliy <br />substandard' shall zx�ean containing defects in structural elernents or a combination af <br />deficiencies in essential utiiities and facilities, 1ig1�t and venti�ation, fire proteciion <br />including adequate egress, layout and condition of interior partitions, or similar <br />factors, which defects or deficiencies are of sufficien# total significance to justify <br />substantial renovation or clearance." <br />a. We do not count energy code deficiencies taward th� thresholds required by <br />Minnesota Statutes, Section 469.174, Subdivision 10(6)) def ned as "structurally <br />s�bstandard", du� to concerns expressed by the State of Minnesota Court of <br />Appeals in the Walser Auto Sales, Inc. vs. City of Richfield case filed Novezx�6er <br />13, 2001. <br />2. Buildings are not eligible to be cansidered structurally substandard unless they meet <br />certain additional criteria, as set for�h in Subdivision 10(c) which states: <br />"A building is not structurally substandard if it is in cornpliance with the building <br />code applicable to new buildings or could be rrtodified to satis�y the buitding code at a <br />Page 5 <br />
