� <br />EN HILL5 <br />MEMORANDUM <br />DATE: December 13, 2010 <br />TO: Honorable Mayor and City Council Members <br />Pairick Klaers, City Administrator <br />FROM: Sue Iverson, Director of �'inance and Admznistrative Services <br />Rebecca Brazys, Deputy Clerk <br />SUBJECT: Arden Hills Tobacco Hearing — Tobacco Sales Violation <br />Back�round <br />On Novennber 24, 201 fl, the Ramsey County Sheriff's Departm�nt conducted tobacco <br />ca�x�.pliance checks ir� Arden Hil�s. Arden Hflls Tobacca did not pass this corzxpliance <br />check because one of their employees sold tobacco prod�cts ta a minox. Subsequent io <br />that incident, the Ramsey Cour�ty Sheriff's De}�at�rnent received a cazx�plaint that another <br />violation had occurred. (Copy attach�d.) <br />Accoxding to o�r City Code, 350.12 Admini�traiive Fines, Suspension, or Revacation, <br />priar to the irnposition of a fine for a tobacco sales violation, a hearing musti be held <br />before the City Council unless the license holder elec�s to waive his rzgk�t to a public <br />hearing. The owner of Arden Hills Tobacco was notx£'ied oi the f ne and hearing via <br />certified mail on December 6, 2010 az�d asked to respond by December 9, 2010. To date, <br />we have received no respo�se. <br />Our City Attorney, rerry Filla, was consulted and his recommendation is attached. <br />Arden Hills Tobacca passed the December 6, 2010, compliance re-check canducted by <br />the Ratnsey County 5heriff. A copy of that notification is also attached. <br />Also attached is a copy of the City's tobacco ordinance for refierence. <br />Requested Action <br />No action required. This is an administrative hearir�g being held iz� compliance with City <br />Code. Per City Cade and the City Attorney's recom�nendation, tl�e fine will be imposed. <br />
