City of Arden Hills Chapter 13 Zoning Code <br />I. Counetl's approval of the final plat of the devetopment tract or a portion <br />thereof by �ollowing the pxocedure and pxoviding the documentation rec��ired <br />for final plat approval in the City's Subdivision Ordinance. In the event the <br />permittee faiIs to commence such proceedis�g to obtain final plat approval <br />within said six (6) month period, the final plat and PUD permit, shall be <br />considered void, nullified and revoked unless an extension is requested in <br />writing by the permittee and for good cause granted by the City Council. <br />Upon appz�ovaI by the City Council, the �nal plat shall contain on its face a <br />cross-reference to the previously approved PUD permit. <br />Subd. b Final Plan. <br />A_ Application, Doc�zznentation and Ad�inastrative Procedure. Within six {6) <br />months after obtaining Master Plan approval, or within sueh extended period <br />of time as the Couneil has agreed ta, the applicant for Pina] Plan approval of a <br />PUD or specific portions of the PUD shalI complete and s�abmit to the zoning <br />administrator an application on such forms as are provided by the <br />adnninistrator, together with the required fee and six (6) copies of the <br />documentatian required in Appendix A, Procedure Manual. In addition to this <br />documentation, a w�tten stateme�t that t�e Final Plan is in conformity with <br />the Master Plan as approved by the Council, or if it is not in eonfarmity with <br />the Master Plan as approved by the Council, he shall specify in said written <br />statement all the deviations frorn the approved Master Plan. The <br />administrative procedure that the City shall use in processing sucl� application <br />shall be that procedure set forth in the Site Plan Review Seetion of Appendix <br />A, Procedure Manual, and Section 1355.04 Subd 5 of this Code. <br />B. Development Agreernent and Bonding to Assure Performance and <br />Conformance to Final Pian_ To assure that alI improvements to be constructed <br />as part of the approved Final Plan are campleted i�a aceordarace with the terms <br />a�d cond�tions of sueh pla�, or each phase thereof as outlined in the <br />cons4ruction orc�er component, the �ity Counci3, at the time oi its approva] of <br />said Final Plan or any �nal plat required thereby, whiehever is �ater, may <br />require the permittee to enter inio and file with the adrninistrator a <br />development agree�xaerat with th:e City and a corporate surety bo�d guarantee- <br />ing the faithful performance of the pern�ittee's obligations �nder said <br />development agreement, and in comp3etion of alI impraverr�ents prov�ded for <br />in said Final Plan in a penai sutn equal to one hundred twenty-five (125) <br />percent af tl�e cost of such i�npro�ve�ents as estimated by the City Engineer, <br />which agreemer�t and bond shall be filed witl� �he administrator no later than <br />thirty (30) days after such requiremer�t has been made by the City Council. In <br />the event the perr�ittee has faiied to enter into said agreement and to �tle the <br />same along with said bond with the admanis�rator by the expiration of said <br />thirty-day period, the PUD Permit, Final Plat (if any) and approved Finai Plan <br />shall be deemed void, nuliified and revoked unIess an extension is requested <br />in writing by the permittee and for good cause granted by the City Council. <br />Section 1320 — District Provisions <br />F�dopted: November l3, 2006 <br />Page 41 of 42 <br />
