City of Arden Hi11s Chapter 13 Zoning Code <br />Subd. 3 Notice of Public Hearing. <br />A. Published Notice. A z�otzce of the time, place and puzpose of �ublic <br />Hearing shali be published in the Official newspap�r at leas� ten (10) days <br />prior to the day of the Hearing. <br />B. Mailed Notice. Rezoning of land, Conditional Use Perrni#s, Interirn <br />Use Permits, and Planned Unit Developments, shall require mailed notice, <br />at least ten (10) days before the day of hearing, to each owner of property <br />situated wholly ar partially within tiiree hundred fifty (350) feet of t1�e <br />boundary of the Property on which the application requiring the Public <br />Hearing is situated. The applicant shall be responsible for providing an <br />accurate list of owners, p�ope�ty identification numbers, addresses and <br />phone numbers to the Zoning Administrator as certified by Ramsey <br />County or a title cozx�pany, printed on addz-ess labels. The City shall be <br />responsible for mailing the notices to the land owners. <br />C. Referral to Others. The administratar shall also refer copies of the <br />applicatzon aa�d required documentation in support thereof to other Ciiy <br />offcials who have an interest therein in accordance with the required <br />administrative distribution schedule. <br />D. Record of Notice. A copy of the notice and a list of the names and <br />addresses to which the notice was sent shall be attested to by the <br />administrator and sk�a11 be �xaade a part of the records of ihe proceedings. <br />E. Failure of Written Notiee. The failure to give mailed notice to <br />individual property owners shall not invalidate the proceedings, provided a <br />bona fide attempt �o comply with this subdivision has been made. <br />Subd. 4 Public Hearing by Planning Commission. Within sixty {60) days after the <br />date of receipt of the corz��leted application frozxi the landowner, by the zoning <br />administrator or the City Council's initiation af the proceedings, the Planning <br />Commission shall hold a public hearing and make a written report to the Council of <br />its findings, conclusions and recommendations, unless the Commission, upon wz-iitten <br />z-equest of the applicant, grants a time extension. The applicant or his representative <br />shall be given the opportunity to appear befare the Commission to answer questions <br />or give explanations regarding the proposal. The Commission xnay adjourn the public <br />hearing to its next meeting, either regular ar special, and may continue its study and <br />consideration of the application at meetings subsequent to the meeting at which the <br />public hearing was initzally held. Upon cozx�pletion of th.e public hearing and its study <br />and consic�eration of the application, the Commission shall submit its written report, <br />containing its findings, conclusions, and recammendations as to the application, to the <br />Council. <br />Section 1355 — Administration and Procedures <br />Adopted: November 13, 2006 <br />Page2of14 <br />
