The proposed plan does not conflict with ihe general purpose <br />and intent of the Zoning Code or the Comprehensive <br />Development P1an for the City. <br />City P1a.nner Beekman stated that based on the findings, Staff <br />recommends approval of Planning Case #09-020 for a Conditional <br />Use Permit at 2 Pine Txee Drive subjeci io the following five <br />conditions: <br />l. The project sha11 be completed in accordance with the plans <br />submitted as amended by the conditions of appzoval. Any <br />significant changes to these plans, as determined by the City <br />Planner, shall require review and approva� by the Planning <br />Commission and Ciry Council. <br />2. A building permi� shall be obtained for all proposed antennas <br />prior to installation. <br />3. A building pern�.ifi shall be obtained for all proposed structures <br />prior to installation. <br />4. A Condiiiona� Use Permit drafted by ihe City Atiarney sha11 be <br />signed by th� applicant and �he property owner prior to the <br />issuance of any building permits. <br />5. The antennas and equipment shall be paint�d to match ihe <br />structu:re to which they are attached. <br />Chair Larson opened the floor to Commission questions. <br />Chair Larson clarified that ihere were no residence near the proposed <br />site. <br />Commiss�oner Stodola asked why the water iowe:r location would not <br />wo�'k for this tower. <br />Mr. Truman, represen�ing Clearwire Wireless LLC, stated that <br />Clearwire was setting up a wir�less internet network. They are <br />putting three antennas in Arden Hi�ls and each tawer needs to be <br />within a half mile of the other and the water tower location did nofi <br />meei this requirement. <br />
