<br />MEMORANDUM <br />DATE: Item 1.B <br /> November 30, 2009 <br />TO: <br /> Mayor and City Council <br />FROM: <br /> Ron Moorse, City Administrator <br />SUBJECT: TCAAP Reimbursables Update <br />Background <br />Based on direction from Council regarding moving forward with a mediation process to resolve <br />the dispute with Ryan Companies regarding TCAAP reimbursable expenses; staff contacted <br />Ryan and the City Attorney to get a list of mediators, and met with the City Attorney to begin to <br />prepare for the mediation. While Eric Anderson of Ryan indicated he would quickly provide a <br />list of mediators, we have not received a list from him, and he has not returned calls requesting <br />the list. The City Attorney has sent a letter to Eric with the City’s list of mediators, and <br />requesting that Ryan provide their list by November 30. <br />Staff has also met with the City Attorney to review documents and information in preparation for <br />the mediation process. The City Attorney will attend the November 30 work session to provide <br />an update regarding preparations for the mediation process. <br />Council Direction Requested <br />Provide additional direction regarding the mediation process. <br />
