_. � , <br />'� .. - 1 <br />LE'iTER OF L}NDERSTANDING <br />CiTY QF ARDEN HILI,S ANp LU.O.U., LUCAL 49 <br />Comrnercial Driver's i.ieense <br />The pu�ose of tt�is Lette�r of U�derstanding �s to assist both Labor and Managernent ir� appl}rir�g the new <br />rules For Corrurzercial Drive�-s License (CDL} hvlders_ The followtng eo�dilions will apply to no more <br />than one (i} Public Works emp�oyee in the Local 49 Bargainmg Unii at any giver� time, and altows only <br />one revoeation per person. <br />If an e:nptoyee temporarity loses hisfher driver's I�cense and CDL, the employee must abtain a <br />valid work per�it thai allows them to d�-ive non�ommercial �ehicles during work haurs_ An <br />emp)oyee that has nQ vaiid �icense �nay be required to use pai� leave ur�ti� they are able to <br />abtaixi a val�d work perrr�it_ Ase ern�Zoyee who d€ies not obtain a drivers license.vith�n ninety <br />{90) days wiii be ter�ninated_ <br />2_ In the opinion of the Depariment Head, there must be sufficient hargai�ing unii ►��ork that does <br />nat requsre a CDL and the irnpacted emptoyee shall possess the skills and abilities to successfully <br />undertake tfiose tasks. <br />3_ if there �s sufficient �uork, the Ernptoyer will accommodate a� er�ployee who tem}�orarity <br />]oses his/her CDL [icense for a period not to exceed orre ( I} year. `TFie one (1) year �eriod begins <br />as of t�e date c�f hislher iicense revocatian. �f t�e employee does not have their CDL reinsiated <br />�vith�n one (1) year, the employee wili be ter�ninated_ <br />4. lf the ter�pvrary loss of a driver's license �s the res�lt ofan alcohol-related alT�ense, t13e employee <br />witl be requ�red to eornply with t�e recommendativns of a S€sbstance Ab�se Professionai_ Proof <br />of compliance w�th the Substance Abuse Professional recam�nenc�at�ons witl be provicied to the <br />Employer. <br />5_ This agreemen� appties {o driv�ng violaiians outside the wark place_ Ti�is agreement daes not <br />include positive test resu3ts f�om t�e Depart�en# af Trans�orEation's reyuired random testir�g_ <br />6_ A twer�ty-�ve percent (25%) decrease in pay will begin as afthe revocatioR date_ Arry lost <br />wages d�ring the revocation of ihe employee's drivers license/CDL wtlt nat bc reir�b�rsed <br />regardtess of t�e outeorne of any subsequeni contesting of the revocation_ <br />This Memwandum of Unclerstanding wili remain in ef#�ecf from lanuary 2, 20(18 thro�gh December 31, <br />2010.
