6. The utility, sewage, and pedestrian easement requirements are met by the proposed plan. <br />Planned Unit Development Review Findings: <br />1. The Master and Final PUD process allows flexibility with the implementation of the <br />City's subdivision and zoning regulations. <br />2. All Zoning requirements are met by the proposed plans with the exception of landscaped <br />lot coverage for Lot 1. <br />3. The land to be transferred to the City will remain as parkland and open space in <br />perpetuity. <br />4. No additional impervious surface will be constructed as a result of this application. <br />Staff Recommendation <br />Staff recommends approval of Planning Case #11-005 for a Preliminary and Final Plat, and <br />Master and Final PUD at 3245 New Brighton Road subject to the following conditions: <br />1. The approval of the purchase agreement by the City Council. <br />2. The applicant shall file the Final Plat with Ramsey County within 180 days of City <br />approval, or the approval for the Final Plat shall expire, unless extended by the City <br />Council prior to the approval's expiration. Extension requests must be submitted in <br />writing to the City at least 45 days prior to the expiration date. <br />3. A shared parking lot agreement shall be signed by the property owners and the City <br />granting the City perpetual use of the Church's parking lot for Hazelnut Park users, <br />and recorded with the County <br />4. A parking lot maintenance agreement shall be signed by the property owners and the <br />City, and filed at the City. <br />Options & Proposed Motion Language <br />1. Recommend Approval with Conditions: Motion to recommend approval of Planning Case <br />11 -005 for a Preliminary and Final Plat, and Master and Final PUD at 3245 New Brighton <br />Road based on the findings of fact and the submitted plans as amended by the conditions in <br />the April 6, 2011, planning case report. <br />2. Recommend Denial: Motion to recommend denial of Planning Case 11 -005 for a <br />Preliminary and Final Plat, and Master and Final PUD at 3245 New Brighton Road based on <br />the following findings: findings to deny should specifically reference the reasons for denial <br />and why those reasons cannot be mitigated. <br />3.
