The structure would encroach ten feet in the <br />required side yard setback of 40 feet. <br />Background <br />1. Overview of Request <br />The applicant is the owner of the home at 1145 Amble Drive. The property is located in the <br />R -1 District, and is a corner lot. The existing home is setback approximately 40 feet from the <br />front property line, which abuts Amble Drive, and 30 feet from the side property line, which <br />abuts Pleasant Drive. The existing home is a nonconforming structure because the current <br />Zoning Code requires a 40 -foot setback from both property lines abutting public streets on a <br />corner lot. The home was constructed in 1979, and the original building permit indicates that <br />the home was conforming when it was built, meaning that the City's ordinance for corner lots <br />has been amended since that time. <br />The applicants are requesting a variance to construct a 408 square foot addition. The single - <br />story addition would extend 24 feet off the rear of the garage, and fill in the eastern corner of <br />the existing home. The addition would not decrease any of the existing setbacks of the <br />principal structure.
