EN HILLS MEMORANDUM DATE: July 6, 2011 TO: Planning Commission FROM: Meagan Beekman, City Planner SUBJECT: Planning Case #11 -014 — Not a Public Hearing Applicant: Bryan Lillehaugen Property Location: 1145 Amble Drive Request: Variance PC Agenda Item 3.A Requested Action The applicant is requesting a variance to construct a 408 square foot addition in the rear and side yard of the home located at 1145 Amble Drive. The structure would encroach ten feet in the required side yard setback of 40 feet. Background 1. Overview of Request The applicant is the owner of the home at 1145 Amble Drive. The property is located in the R -1 District, and is a corner lot. The existing home is setback approximately 40 feet from the front property line, which abuts Amble Drive, and 30 feet from the side property line, which abuts Pleasant Drive. The existing home is a nonconforming structure because the current Zoning Code requires a 40 -foot setback from both property lines abutting public streets on a corner lot. The home was constructed in 1979, and the original building permit indicates that the home was conforming when it was built, meaning that the City's ordinance for corner lots has been amended since that time. The applicants are requesting a variance to construct a 408 square foot addition. The single - story addition would extend 24 feet off the rear of the garage, and fill in the eastern corner of the existing home. The addition would not decrease any of the existing setbacks of the principal structure.
