Plannin Commission Review and Public Hearin <br />The Plaru�ing Commission reviewed the proposed xedevelapment at their August 3, 2011, <br />meeting. The meeting also included a public he�ing. The Augusi 3, 2011, Planning <br />Co�runission packet for this planning case that includes Staff's full anaiysis and the presented <br />plan set is included as Attachment C. <br />The P�aru�ing Com�nission offers the following findings of fact: <br />1. The applicant is requesting approval of an amendrz�ent to the Final PUD for 1'hase T and a <br />Prel'ux�inary and Final Plat for the Arden Plaza property. <br />2. The PUD process allows for flexibi�ity within the City's regulatians through a negotiated <br />process with a developer. <br />3. The Axden Plaza property is located in the B2 General Business D'zstrict. <br />4. The proposed redeveloprnent is a permitted use in the B2 District. <br />5. The City has adopted the Guiding Plan for the B2 District that outlines future <br />development principals for the area. <br />6. The City has adopted design siandards for the B2 disi7'ict within the Zoning Code. <br />7. The Master PUD and Final PUD far Phase � axe in substantial conformance witn the <br />requirements of the City's Zoning Code and design standards. <br />S. The Master PUD and Final PUD �or Phase I are in substantial conformance wi�h tl�e <br />Guiding Plan �or the B2 District. <br />9. The Master PUD and Final PUD for Phase I are in substantial conforrnance with the <br />City's Comprehensive Plan. <br />10. Where the plan is not in conformance w'rth the City's Zaning Code, flexibility has been <br />requested by the applicant and/or conditians have been placed on an approval that would <br />rr�itigate ihe nonconformit�. <br />11. The application is not anticipated to create a negative impact on the immediate area or the <br />cornmux�ity as a whole. <br />Recommendation <br />The Planning Cornrnission �eviewed Planning Case 11-01b and unanimously recom.mends <br />approval of an a.mendme�t to the Final PUD for Phase 1 and a Preliminary and �'inal Plat for the <br />Arden Plaza redeveIopm�nt proposal at 3585 Le�ington Avenue, based on the fndings of fact <br />and the submitted plans as presente�. in the August 29, 2011, report to the City Council, as <br />arnended b� the �ollawing eight conditions: <br />�. The applicant shall continue to abide by the cpnc�itions of all previous Master PUD <br />and Final PUD for Phase I, permits, and reviews, except as hereinafter amended. <br />2. The project shall be complete�. in accordance with the submitted plans as amended by <br />the conditions of approval.
