Planning Case 11-006 for a Comprehensive Plan Amendment Adding Very Low Density <br /> Residential as a Land Use Classification in the 2030 Comprehensive Plan and Re-guiding <br /> the Property at 4500 Snelling Avenue North as Very Low Density Residential (continued) <br /> City Attorney Filla suggested the motion be moved to be included with item 8C because the <br /> person most impacted by the reclassification of the property is not in attendance <br /> Councilmember Holden withdrew her motion. <br /> Councilmember Holmes withdrew her second to the motion. <br /> MOTION: Mayor Grant moved and Councilmember Holden seconded a motion to <br /> Suspend the Rules for the Purpose of AlterinjZ the Agenda to Move_Item 7A to <br /> be Included with Item. 8C. The motion carried unanimously (5-0). <br /> 8. UNFINISHED BUSINESS <br /> A. Hazelnut Purchase Agreement—Final Approval <br /> Community Development Director Hutmacher stated Trinity Lutheran Church, located at 3245 <br /> New Brighton Road, is a four-and-a-half-acre parcel surrounded on two sides by Hazelnut Park, a <br /> City-owned property. In 2009, the Church approached the City to discuss the sale of a portion of <br /> the Church property, which the City has used for a soccer field. The City Council reviewed the _ <br /> proposal at two work sessions in 2010 and directed Staff to move forward with the acquisition of <br /> approximately 71,000 square feet at a purchase price of $3.00 per square foot. The land area <br /> proposed includes the trail entrance to the park, soccer field, and the park identification sign. In <br /> addition to the sale of the land, the Church has agreed to formalize a Joint Use Agreement which <br /> will be recorded against the property, ensuring designated park parking into the future. In addition <br /> to the City Council, the Financial Planning and Analysis Committee and the Parks, Trails, and <br /> Recreation Committee have reviewed the proposal and recommended that the City move forward <br /> with a purchase if an acceptable purchase price could be negotiated. At the January 31, 2011, <br /> work session, the Council reviewed the draft Purchase and Joint Use Agreements for the Hazelnut <br /> Park acquisition and directed Staff to proceed with finalizing the Purchase Agreement for 71,474 <br /> square feet of land at $3.00 per square foot from Trinity Lutheran Church. The closing date has <br /> been postponed until June 29, 2011. Ms. Hutmacher outlined the proposed Purchase Agreement <br /> and Maintenance Agreement changes since the January 31, 2011,work session. <br /> Councilmember Holden stated the City is purchasing this property for the purpose of expanding <br /> the City's parks. She asked if it could be written into the purchase agreement or a different <br /> document to ensure this property remains parkland. <br /> City Attorney Filla stated the City would have the title for this property and this Council or <br /> future Councils could choose to do something different with the land. <br /> Councilmember Holden asked for clarification on who would be responsible for determining <br /> what potholes would be filled. <br />
