Planning Commission Recommendation <br /> The Planning Commission recommends approval of Planning Case 12-019, based on the findings <br /> of fact and submitted plans as amended by the conditions of approval in the December 17, 2012, <br /> report to the City Council (Attachment B). The Planning Commission further recommends that <br /> shared access between the subject property and the properties to the west be pursued; however, <br /> the Planning Commission expressed concern over requiring the owner of 1201 County Road E to <br /> vacate portions of their property with no compensation to the benefit of another private property <br /> owner. <br /> Staff Recommendation <br /> Staff recommends approval of Planning Case 12-019, based on the submitted plans, as amended <br /> by the conditions of approval. Staff has met with the City's Attorney to discuss the shared <br /> access layout issue. Based on those discussions, staff recommends the following conditions of <br /> approval: <br /> 1. Development agreements, drafted by the City Attorney, shall be signed by the <br /> property owners prior to the issuance of development permits. <br /> 2. The project shall be completed in accordance with the plans submitted as amended by <br /> the conditions of approval. Any significant changes to these plans, as determined by <br /> the City Planner, shall require review and approval by the Planning Commission and <br /> City Council. <br /> 3. Prior to the City's approval of a development agreement, the applicant shall submit <br /> revised plans incorporating the shared access layout (Attachment D). The applicant <br /> shall be responsible for construction of the portion of the shared access as shown on <br /> the revised plans, except those portions of the shared access to be located within <br /> shared easements. <br /> 4. At the City's request, in conjunction with the construction of the shared access by <br /> others, but within ten years, the property owner shall close the westernmost access <br /> and relocate to a shared access along the western side of its property and modify its <br /> parking lot and access lanes solely at its own costs as shown in the attached shared <br /> access layout. <br /> 5.
