(8) The holder of a premises permit or bingo hall license shall notify the City,in writing,of any <br /> change in the information required under Section 127.030(8)within ten(10)days. As a <br /> condition of the approval of a premises permit or bingo hall license,a licensee shall consent <br /> to the access of its financial records by the City,and failure to consent to the access of these <br /> records shall be grounds for the revocation or suspension of the premises permit or bingo <br /> hall license. <br /> (9) On or before the one(1)year anniversary of the issuance of a premises permit or bingo hall <br /> license,the City Council shall hold a formal review of the licensee's or permit holders' <br /> compliance with this Chapter,and/or Minnesota Statutes. Bingo hall licensees are one(1) <br /> year licenses and are reviewed annually. Upon a finding of non-compliance,the City may <br /> revoke or suspend a bingo hall license,organizational license,or premises permit. <br /> 127.070 Required Conditions. Each organization conducting lawful gambling within the City shall <br /> contribute at least ten percent(10%)of its net profits derived from lawful gambling in the City to <br /> a fund administered and regulated by the City without cost to the fund,for disbursement by the <br /> City for lawful purposes as defined by Minn. Stat. Section 349.12,subd.25. The City's use of <br /> these funds shall be one hundred percent(100%)to the Community Service Fund. For the <br /> purposes of this Section,net profits are defined as gross profits less reasonable sums actually <br /> expended for allowable expenses. Each organization will be required to remit the contribution <br /> required under this Section to the City for net profits for the preceding month,within thirty(30) <br /> days of the last day of the preceding month. <br /> 127.080 Law Enforcement and Administrative Costs. A local gambling tax may be imposed on all <br /> organizations licensed to conduct lawful gambling within the City. No local gambling tax will be <br /> imposed in 2007. In future years,the City Council shall determine annually at its first meeting in <br /> January whether or not such gambling tax will be charged in that year. The tax may not exceed <br /> three percent(3%)of the organization's gross profit from gambling activities within the City. <br /> Proceeds of the tax shall be placed in a special fund to be administered by the City to be utilized <br /> solely for the purpose of regulating all gambling activities within the City,including,but not <br /> limited to,the reimbursement of the City's administrative,legal,law enforcement and consulting <br /> costs. <br /> 127.090 Trade Area. The Vadnais Heights Trade Area is defined as the corporate boundaries of the City <br /> of Vadnais Heights and the boundaries of each city and town contiguous to the City of Vadnais <br /> Heights. Fifty percent(50%)of the net profits from lawful gambling conducted within the City <br /> of Vadnais Heights shall be expended on lawful purposes conducted within the Vadnais Heights <br /> Trade Area,of which a minimum of fifty percent(50%)is expended within the City limits of <br /> Vadnais Heights. The percentage expended within Vadnais Heights corporate limits for an <br /> organization may be lowered to an individual organization by council resolution on an annual <br /> basis if determined by the City Council to be in the best interest of the greater community. <br /> 127.100 Gambling-Egypt from State Licensing Requirements. <br /> (1) Organizations which conduct lawful gambling which is exempt from State gambling <br /> licensing requirements may conduct such gambling within the City upon receipt of a permit <br /> from the City,except this requirement does not apply to door prizes or raffles and bingo, <br /> where total prizes are less than seven hundred and fifty dollars($750.00)in a calendar year. <br /> (2) An application for such a permit,along with the required fee,shall be made at least thirty <br /> (30)days prior to the date such gambling is to be conducted. The required fee shall be <br /> established annually in the City's fee register. The application shall contain the following: <br /> (a) The name of the organization. <br /> (b) The address of the organization. <br /> 127-3 <br />
