�S N, ILLS <br /> CITY OF ARDEN HILLS <br /> COUNTY OF RAMSEY <br /> STATE OF MINNESOTA <br /> RESOLUTION NO. 2012-052 <br /> RESOLUTION APPROVING PLANNING CASE 12-019 FOR A PLANNED UNIT <br /> DEVELOPMENT AT 1201 COUNTY ROAD E <br /> WHEREAS, the Planning Case 12-019 for a Master and Final Planned Unit <br /> Development at 1201 County Road E is now before the City Council for review and <br /> approval addressing conversion of a former hotel into 75 units of multi-family housing and <br /> approximately 20,000 square feet of retail and associated site improvements; and <br /> WHEREAS, the Planning Commission held a public hearing and reviewed the <br /> application, submitted documentation, staff's recommendation, and public comments <br /> regarding Planning Case 12-019, and unanimously recommended approval for the <br /> application; and <br /> WHEREAS, the City Council reviewed the complete application, submitted <br /> documentation, and Planning Commission recommendation regarding Planning Case 12- <br /> 019; and <br /> WHEREAS, the City Staff have recommended approval of Planning Case 12-019 <br /> for a Master and Final Planned Unit Development at 1201 County Road E. <br /> NOW, THEREFORE, BE IT RESOLVED that Planning Case 12-019 for a <br /> Master and Final Planned Unit Development at 1201 County Road E be approved, subject <br /> to the following conditions: <br /> 1. Development agreements, drafted by the City Attorney, shall be signed by the <br /> property owners prior to the issuance of development permits. <br /> 2. The project shall be completed in accordance with the plans submitted as <br /> amended by the conditions of approval. Any significant changes to these plans, <br /> as determined by the City Planner, shall require review and approval by the <br /> Planning Commission and City Council. <br /> 3. Prior to the City's approval of a development agreement, the applicant shall <br /> submit revised plans incorporating the shared access layout (Attachment Q. <br /> The applicant shall be responsible for construction of the portion of the shared <br /> access as shown on the revised plans, except those portions of the shared access <br /> to be located within shared easements. <br /> 4. At the City's request, in conjunction with the construction of the shared access <br /> by others, but within ten years, the property owner shall close the westernmost <br /> access and relocate to a shared access along the western side of its property and <br />
