Such Certificate of Completion shall be a conclusive <br /> determination of satisfaction and termination of the agreements and covenants in this Agreement with respect to <br /> the Developer's obligations to construct the Improvements (but not the obligations related to the shared access,the <br /> sidewalk easement and payment, or the County roadway easement). If the City shall refuse or fail to provide a <br /> Certificate of Completion in accordance with the provisions of this Section, the City shall, within ten (10) days after <br /> written request by the Developer, provide the Developer with a written statement, indicating in adequate detail in <br /> what respects the Developer has failed to complete the Improvements in accordance with the provisions of the <br /> Agreement,or is otherwise in default, and what measures or acts will be necessary, in the opinion of the City,for the <br /> Developer to perform in order to obtain a Certificate of Completion. <br /> 8. PERMITS. The Developer shall obtain or require its contractors and subcontractors to obtain all necessary <br /> permits,which may include: <br /> • Minnesota Department of Health for Watermains <br /> • MPCA Sanitary Sewer Extension Permit <br /> • MPCA-NPDES Construction Stormwater Permit <br /> • DNR for Dewatering <br /> • Rice Creek Watershed District Permit <br /> • City of Arden Hills Grading and Erosion Control Permit <br /> • City of Arden Hills Building Permits <br /> 9. DEWATERING. Due to the variable nature of groundwater levels and stormwater flows, it will be the <br /> Developer's and the Developer's contractors and subcontractors responsibility to satisfy themselves with regard <br /> to the elevation of groundwater in the area and the level of effort needed to perform dewatering and storm flow <br /> routing operations. All dewatering shall be in accordance with all applicable county, state, and federal rules and <br /> regulations. DNR regulations regarding appropriations permits shall also be strictly followed. <br /> 10. TIME OF PERFORMANCE. The Developer shall install all required Improvements for the Site as <br /> contemplated by Sections 5 and the approved Plans within one year after the Effective Date, or the City's approval <br /> shall expire unless extended by approval from the City Council.
