87 MINNESOTA STATUTES 2011 469.091 <br /> ECONOMIC DEVELOPMENT AUTHORITIES <br /> 469.090 DEFINITIONS. <br /> Subdivision 1. Generally. In sections 469.090 to 469.108, the terms defined in this section <br /> have the meanings given them herein, unless the context indicates a different meaning. <br /> Subd. 2. Authority. "Authority" means an economic development authority. <br /> Subd. 3. City. "City" means a home rule charter or statutory city. <br /> Subd. 4. Development. "Development" includes redevelopment, and "developing" includes <br /> redeveloping. <br /> Subd. 5. Cost of redevelopment. "Cost of redevelopment" means, with respect to an <br /> economic development district project, the cost of: <br /> (1) acquiring property, whether by purchase, lease, condemnation, or otherwise; <br /> (2) demolishing or removing structures or other improvements on acquired properties; <br /> (3) correcting soil deficiencies necessary to develop or use the property for an appropriate <br /> use as determined by the authority; <br /> (4) constructing or installing public improvements, including streets, roads, and utilities; <br /> (5) providing relocation benefits to the occupants of acquired properties; <br /> (6) planning, engineering, legal, and other services necessary to carry out the functions <br /> listed in clauses (1) to (5); and <br /> (7) the allocated administrative expenses of the authority for the project. <br /> History: 1987 c 291 s 91 <br /> 469.091 ECONOMIC DEVELOPMENT AUTHORITY. <br /> Subdivision 1. Establishment. A city may, by adopting an enabling resolution in <br /> compliance with the procedural requirements of section 469.093, establish an economic <br /> development authority that, subject to section 469.092, has the powers contained in sections <br /> 469.090 to 469.108 and the powers of a housing and redevelopment authority under sections <br /> 469.001 to 469.047 or other law, and of a city under sections 469.124 to 469.134 or other law. <br /> If the economic development authority exercises the powers of a housing and redevelopment <br /> authority contained in sections 469.001 to 469.047 or other law, the city shall exercise the powers <br /> relating to a housing and redevelopment authority granted to a city by sections 469.001 to <br /> 469.047 or other law. <br /> Subd. 2. Characteristics. An economic development authority is a public body corporate <br /> and politic and a political subdivision of the state with the right to sue and be sued in its own <br /> name. An authority carries out an essential governmental function when it exercises its power, <br /> but the authority is not immune from liability because of this. <br /> Subd. 3. Unpaid officers, directors, and agents; liability.
