CONSENT ITEM <br /> <br /> <br />MEMORANDUM <br /> <br />DATE: March 11, 2013 <br /> <br />TO: Honorable Mayor and City Councilmembers <br />Patrick Klaers, City Administrator <br /> <br />FROM: Amy Dietl, Deputy Clerk <br /> <br />SUBJECT: City Code Updates <br /> <br /> <br />Requested Action <br /> <br />Approve Ordinance 2013-003 to amend City Code Chapter 10, Subd. 3 and Chapter 6, Subd. 5 (A) to <br />make the City Code language consistent with language found in the 2013 Fee Schedule. <br /> <br />Approve publishing a summary of Ordinance 2013-003. <br /> <br />Background/Discussion <br /> <br />The 2013 Fee Schedule was adopted by ordinance at the December 10, 2012, City Council meeting. <br />Since its adoption, two chapters of the City Code require minor language changes to accurately reflect <br />what is now in the fee schedule. <br /> <br />First, when looking at previously adopted fee schedules, it appears as though no fee has been charged <br />for customer requested water meter accuracy testing if the meter is found to be inaccurate to a degree <br />exceeding three percent (3%). This language has been in the fee schedule for at least the past four <br />years; however, this language is inconsistent with Chapter 10 (Utilities), Subd. 3 (Meter Accuracy <br /> <br />Testing) of the City Code. City Code currently reads five percent (5%); therefore, needs to be updated. <br />To avoid the necessity of updating the City Code whenever the fee schedule is adopted, specific <br /> <br />numbers will not be included and it will only reference fees established in the fee schedule. <br /> <br />Second, the 2013 Fee Schedule adopted new numbers for false alarm fees; therefore, Chapter 6 <br />(Nuisances and Offenses), Subd. 5 (A), language also needs to be updated to be consistent with the fee <br />schedule. <br /> <br />Attachments <br /> <br />Attachment A: Red-lined copy of Chapter 10, Subd. 3 <br />Attachment B: Red-lined copy of Chapter 6, Subd. 5 (A) <br />Attachment C: Ordinance 2013-003 and Publication Summary. <br />11 <br />Page of <br /> <br />
