CONSENT ITEM <br /> <br /> <br />MEMORANDUM <br /> <br />DATE: March 8, 2013 <br /> <br />TO: Honorable Mayor and City Councilmembers <br />Patrick Klaers, City Administrator <br /> <br />FROM: Terry Maurer, Public Works Director <br /> <br />SUBJECT: Innovation Way/County Road F Pond Dredging <br /> <br /> <br />Budgeted Amount: Actual Amount: Funding Source: <br />$12,500 $11,070 Surface Water Management <br />Utility Fund <br /> <br />Requested Action <br /> <br />dredging of the storm water located at Innovation Way and County Road F. <br /> <br />Discussion <br /> <br />In late 2011 City staff was contacted by Boston Scientific about the possibility of sharing in the <br />cost of dredging the storm water pond located at Innovation Way and County Road F. Their <br />request was to commit to a one-third share along with Xcel Energy (who has a substation located <br />adjacent to the pond) and Boston Scientific. The rationale for the City to share in the costs is that <br />Innovation Way was previously a City street and the storm sewer system drains to this pond. <br /> <br />Once the request was received from Boston Scientific, staff discussed the issue with the City <br />Attorney to determine if there were any agreements on the turn back of Innovation Way that <br />would deal with this issue. The answer from the City Attorney was the turn back agreement was <br />silent on this issue. Therefore, this item was presented to the City Council as part of the 2012 <br />CIP discussion. The $12,500 item for our share of the pond dredging was included in the 2012 <br />CIP. Due to procurement issues, the project was not completed in 2012 so the item was moved <br />to 2013 in the most recent CIP. <br />12 <br />Page of <br /> <br />
