CONSENT ITEM <br />MEMORANDUM <br />DATE:May 13, 2013 <br />TO:Honorable Mayor and City Councilmembers <br />Patrick Klaers, City Administrator <br />FROM:Jill Hutmacher, Community Development Director <br />SUBJECT:Amendment of Section 1250.03 Subd. 1 of City Code <br />Budgeted Amount:Actual Amount:Funding Sources: <br />NANANA <br />Requested Action <br />Approve Ordinance 2013-005 amending Section 1250.03 Subd. 1 of the City Code relating to the <br />placement of off-premise signs. <br />Approve publishing a summary of Ordinance 2013-005. <br />Discussion <br />Section 1250.03 of the City Code relates to temporary off-premise signs. The section was <br />originally intended to allow placement in the right-of-way of signs advertising garage or estate <br />sales. Signs may be displayed for three consecutive days in any seven-day period. <br />It has recently come to the City’s attention that, because Section 1250.03 does not specifically <br />refer to residential properties, it can be interpreted to allow commercial properties up to five off- <br />premise signs in the right-of-way.Commercial properties are currently allowed temporary on- <br />premise signs under the regulations described in Section 1250.02 of the City Code. <br />In order to clarify that Section 1250.03 isfor the benefit of residential properties, the following <br />code amendment is suggested. <br />Subd. 1 Sign Number Limit. Each residential property is allowed upUpto five (5) <br />freestanding, temporary, off-premise signs may be placed in the City right-of-way or on <br />private property provided that the signs: <br />12 <br />Page of <br />
