2 <br />BrewstillerytoobtainaCUPtoopenabreweryanddistilleryina2,500squarefootbay <br />intheB-4ZoningDistrictat1160RedFoxRoad.BentBrewstillerywouldliketo <br />includeataproomfortheconsumptionofon-salebeerbrewedonsite,aswellasoff-sale <br />sales of growlers and 750 ml bottles. <br />Theapplicantproposesthelargeretailspaceandtaproomwillservethefollowing <br />purposes: <br />Sellbeergrowlers(64-ozbottles)andbombers(22-ozbottles)foroff-premise <br />1. <br />consumption as allowed by Minnesota law, <br />2.Sell pints for on-premise consumption in accordance with the Minnesota Pint Law, <br />Sellspiritsforon-premiseconsumption(whenlegal)inaccordancewithMinnesota <br />3. <br />Law, <br />4.Sell company swag, <br />5.Provide free beer (and bourbon when legal) samples, <br />6.Start and end point for Brewstillery tours, <br />Serveasagatheringspottodiscussbeer,bourbon,andotherpoignanttopicsofthe <br />7. <br />day. <br />This application includes three distinct requests: <br />ZoningCodeAmendmenttocreatethreenewlanduses;microbrewery,micro <br />1. <br />distillery,andbrewpub;andallowthenewusesintheB-4DistrictasConditional <br />Uses. <br />CityCodeAmendmenttocreatetwonewliquorlicensesforonandoff-salesalesof <br />2. <br />microbrews brewed on site in a micro brewery. <br />ApprovalofaConditionalUsePermittoallowamicrobreweryandmicrodistillery <br />3. <br />with taproom at 1160 Red Fox Road <br />CityPlannerMeaganBeekmanpresentedthelegalbackgroundstatingin2011,theState <br />LegislatureamendedStateLawtoallowtaproomsinmicrobreweriesinMinnesota.This <br />billwascommonlyreferredtoastheandwasfirstproposedbytheownerof <br />SurlyBrewery.Thelawallowsmicrobreweriesthatproducefewerthan250,000barrels <br />ofbeerinayeartohaveataproomwheretheycansellbeerforonsiteconsumption, <br />whichisbrewedonsite.Thelawalsoallowssamplingofbeer,whichisproducedon <br />site. <br />Statelawalsoallowsmicrobrewerieswhichproducefewerthan3,500barrelsofbeera <br />yeartoprovideoff-salesalesof64ounceand750milliliterbottles;however, <br />off-sale sales of beer by the bottle, case or keg is not permitted by State law. <br />Thesaleofonandoffsaleproductsbrewedonsiteisallowedformicrobreweriesbutnot <br />microdistilleries(manufacturersofspirits).DistilleriesareallowedbyStateStatute,but <br />cannotprovideon-sale,off-sale,andsalesoftheirproductsatthelocationinwhichthe <br />spiritsareproduced.Thespiritsmustbedistributedtoanothersiteforonandoffsale <br />sales. <br />MunicipalordinancesmaybemorerestrictivethanStatelawintermsofthesaleof <br />alcohol. <br />City Planner Meagan Beekman reviewed the proposed land use definitions. <br />
