*Floor Areais the sum of all floors of the structure not including coveredporches, decks; <br />any space where the average floor-to-ceiling height is less than six feet; attached or <br />detached garages and other detached accessory structures. <br />*Floor Area Ratio(FAR) is the ratio obtained by dividing the sum of a building’s floor <br />area by the amount of lot area. <br />F.Structure Height –Meets Requirements <br />The existing dwelling with the proposed addition would not exceed the 35 foot height <br />limit.The proposed height of the structure is twenty-nine (29) feet four (4) inches. <br />G.Tree Preservation <br />Theproposed additionsshould not impact the trees on the property. If any trees are <br />removed as a result of the project, the application will be required to meet the City’s tree <br />preservation standards, and mitigation may be necessary. <br />2.Flood Plain, Wetlands, and Easements <br />The proposed additionsareoutside of any floodplains, wetlands, or easements. <br />3.AdditionalReview <br />a. <br />The Rice Creek Watershed District did review the plans for thisrequest and <br />determined that a RCWD Permit would not be required for the proposed project at <br />1226 Ingerson Road. <br />b. <br />The Building Official reviewed the plans for the project and had no additional <br />comments. <br />c. <br />The City Engineer reviewed the proposal and stated he hadno comments related to <br />the project. <br />VarianceEvaluation Criteria <br />On May 5, 2011, the Governor signed into law new variance legislation that changed the review <br />criteria citiesmust use when evaluating variance requests. The new law renames the municipal <br />variance standard from “undue hardship” to “practical difficulties,” but otherwise retains the <br />familiar three-factor test of (1) reasonableness, (2) uniqueness, and (3) essential character.
