9.Dwellings and garages are permitted structures within the R-1Single Family Residential <br />Zoning District. <br />10.The existing dwellingand proposed additions are outside of the 100-year flood plain, <br />wetlands, and easements. <br />Variance Findings: <br />1.The proposal is in harmony withthe purpose and intent of the ordinance because the <br />ordinance generallyallows flexibility for unique parcelswhen impacts to surrounding <br />properties are minimized. <br />2.The proposal is consistent withthe comprehensive plan because it allows the reasonable <br />use of residential property. <br />3.The homeadditionsaregenerallypermitted and reasonable uses within the R-1Single <br />Family Residential Zoning District. <br />4.The lot is comparably unique in the City.The property is situated on the curve where <br />Ingerson Road intersects with Ingerson Court,thereforecreating three(3)front yard <br />setback requirements to the north, south, and west sides of the lot. <br />5.Since the proposed addition would not encroach much furtherinto the front yard setbacks <br />than the existing structure, the additions areunlikely to have a negative impact on the <br />property or the neighborhood. The minor encroachmentswould have aminimalvisual <br />impactfrom Ingerson Road or Ingerson Court. <br />6.The additionsmaybe visible from neighboringproperties; however,the property is in a <br />relativity wooded area which should minimize the impacts on surrounding property <br />owners. <br />7.The proposed plans and requested variancesfor the dwelling do not appear to be based on <br />economic considerations alone. <br />Staff Analysis <br />The findings of fact for this variance request support a recommendation for approval.However, <br />if the Planning Commission choosesto make a recommendation for denial,the Findings of Fact <br />would need to be amended to reflect the reasons for the denial. <br />If the Planning Commission recommends approval on this variance, Staff recommends the <br />following four(4)conditions: <br />1.That the project shall be completed in accordance with the plans submittedand dated <br />9-6-13,as amended by theconditions of approval.
