City of Arden Hills Personnel Policy Effective August 26, 2003 <br /> <br />2. Corrective Action <br />Involving Employees: <br />Within a reasonable period of time, a determination based on the <br />shall be made whether the conduct of the person against whom a c <br />discrimination, harassment and/or inappropriate behavior has bee <br />constitutes discrimination, harassment and/or inappropriate behavior. <br />making that determination, the report as a whole and the totalit <br />circumstances, including the nature of the conduct in question, <br />which the conduct, if any, occurred, and the conduct of the person accused of <br />discrimination, harassment and/or inappropriate behavior shall b <br />The determination of whether discrimination, harassment and/or i <br />behavior occurred shall be dealt with on a case-by-case basis. <br /> <br />If it is determined that the complaint of discrimination, harass <br />inappropriate behavior is founded, immediate and appropriate dis <br />action shall be taken against the employee guilty of discriminat <br />and/or inappropriate behavior, consistent with the city ordinances, rules or <br />regulations pertaining to employee discipline. <br /> <br />The disciplinary action shall be consistent with the nature and <br />offense, the rank of the employee and any other factors deemed a <br />including but not limited to, the effect of the offense on employ <br />public perception of the offense, and the light in which it casts the city. A <br />determination of the level of disciplinary action shall also be -by- <br />case basis. <br /> <br />A written record of disciplinary action taken shall be kept, including v <br />reprimands. <br /> <br />Involving the City Administrator: <br />Upon receipt of a report on the investigation of a complaint of <br />harassment and/or inappropriate behavior against the City Administrator, the <br />Mayor shall present the report the City Council.If the City Council determines <br />that the complaint of discrimination, harassment and/or inapprop <br />is founded, it may discipline the City Administrator consistent ity <br />under the municipal ordinances, resolutions, rules and agreement <br />discipline of the City Administrator. <br /> <br />Involving Non-employees: <br />In cases of discrimination, harassment and/or inappropriate beha <br />committed by a non-employee against a city employee in the work place, the <br />lawful steps shall be taken to halt the discrimination, harassme <br />inappropriate behavior. <br /> <br /> 45 <br />
