Currently there are no districts designated for parks or open space areas in the Zoning Code <br />(Attachment D). Park facilities are integrated into residential or business zoning districts. <br />Minnesota State law requires that local zoning codes be consistent with adopted comprehensive <br />plans. Establishing a Parks and Open Space District and a Conservation District would help the <br />City meet this requirement. Further, the new districts will assist in the implementation of the <br />es within the Zoning Code. <br /> <br />A draft version of the proposed districts was presented at the May 28, 2013, City Council work <br />session. The discussion at that meeting focused on the types of uses that should be allowed in the <br />districts, appropriate special regulations, and how to address privately owned parks. Staff has <br />attempted to incorporate the issues raised at this meeting into the proposed Ordinance 2013-010 <br />for a Conservation District and Ordinance 2013-011 for a Parks and Open Spaces District. The <br /> <br />Planning Commission reviewed Planning Case 13-004at the October 9, 2013, meeting and <br />recommended approval of both Ordinances (Attachment F). <br /> <br /> <br />Summary of Proposed Ordinance Amendments and Additions <br /> <br />The Parks and Open Space District would be applied to City and County Parks. This district <br />could also be appropriate for City-owned parcels that are being used as public open space or that <br />corresponds with the Park Preserve District in the Comprehensive Plan and could only be applied <br />to the Arden Hills Army Training Site (AHATS). <br /> <br />It should be noted that this case only includes amendments to the Zoning Code. No rezoning of <br />any property is being proposed at this time. Staff has provided a hypothetical illustration of the <br />Zoning Map if the new districts were to be applied (Attachment E). <br /> <br />If adopted, Ordinance 2013-010 and Ordinance 2013-011 would amend or add regulations to two <br />chapters of the Zoning Code: <br /> <br /> <br />A.1305.04 Definitions (new definition) <br /> <br />B.1320 District Provisions (new regulations) <br /> <br />A general discussion on the changes to each chapter is outlined in the sections below.
