The Zoning Code does not include specific regulations regarding acceptable levels of noise. However, all properties in the City must meet the noise rules established by the State of land use at the location of the person that hears the noise. The Minnesota Pollution Control Agency has been given statutory authority to enforce the State noise rules. 10.Additional Review The City Engineer and Building Official have reviewed the application and do not have any additional comments. Findings of Fact The Planning Commission must make a finding as to whether or not the proposed PUD Amendment and Site Plan Review at 4100 Hamline Avenue North would adversely affect the surrounding neighborhood or the community as a whole based on the aforementioned factors. Staff offers the following eight (8) findings of fact for consideration: 1. A Master PUD was approved for 4100 Hamline Avenue North in Planning Case #02-025. 2. The proposed 1,310 square foot addition to Building 14 was not included in the approved Master PUD and an amendment to the PUD is therefore required. 3. The Master PUD requires that a Site Plan Review be applied for prior to the construction of any building or addition. 4. The property is located in the I-1: Limited Industrial District. 5. The proposal is in substantial conformance with the zoning and design standard requirements for the I-1: Limited Industrial District. 6. 7. The proposal is not expected to exceed noise limits set by the Minnesota Pollution Control Agency. 8. The proposal will not adversely impact the surrounding neighborhood or the City as a whole. Notice Notice was published in the Arden Hills/Shoreview Bulletin and notice was prepared by the City and mailed to residents within five hundred (500) feet of the subject property.
