CONSENT ITEM 5C <br /> <br /> <br />MEMORANDUM <br /> <br />DATE: May 12, 2014 <br /> <br />TO: Honorable Mayor and City Councilmembers <br />Patrick Klaers, City Administrator <br /> <br />FROM: John Anderson, Assistant City Engineer <br /> <br />SUBJECT: Site Use Lease Agreement with Nextel West fka Sprint <br /> <br /> <br /> <br />Requested Action <br /> <br />Approve the Site Use Lease Agreement with Nextel West Corporation for the lease of City <br />property located at 1230 Red Fox Road. <br /> <br />Background/Discussion <br /> <br />Prior to February 2010, d water <br />the Nextel lease. At this time, Sprint has proposed modifications to its equipment and number of <br />antenna at the Red Fox water tower. The modifications are beyond what is allowed under the <br />terms of the current lease which expires in 2020. <br /> <br />As wireless contracts expire, or providers ask to make changes inconsistent with current lease <br />agreements, the City would like to make the terms of the agreements more consistent for easier <br />administration of the contracts. Also, the City would like to increase lease rates to be more <br />reflective of the current market. <br /> <br />SEH provided a master form of a wireless site lease agreement which is based on <br />recommendations from the League of Minnesota Cities. Staff and the City Attorney negotiated <br />the lease agreement with Sprint. Sprint has approved the new lease agreement and would like to <br />move forward with their upgrade project. <br /> <br />The City currently has wireless contracts with Sprint/Nextel, T-Mobile, and TTM at the Red Fox <br />water tower. The City has contracts with AT&T, T-Mobile, and Zayo at the Cummings Park <br />water tower. Neither TTM nor Zayo have equipment on the tower which is reflected in their <br />lower lease rates.
