i. . . ... . .... . . . ... . . . . ... .. . ... .. .....] . . ... .. . . . -. . .. . ....... . , _ .. ... ... - .. . . . . . . ....... . <br />� � � � . f- . � - . � � . � .. -. �- � .. . � . . . . . . . . .. . <br />�.- AMENDMENT <br />TO FIRE PROTECTION AGREEMENT <br />: : DATED THE 3RD DAY.OF-OCTOBER, 1977. <br />In �pnsideration of the respective undertakings herein contained, the <br />parties enter into this Agreement this lst day of _ Jul�_ , <br />1 )82. --------- <br />� i <br />SECTION 1 , <br />Parties � <br />The first parties to this Agreement are the City of Shoreview, the' <br />City of Arden Hills, and the City of North Oaks, each a municipal corporation <br />of the State of Minnesota operating as a statutory city under Minnesota <br />Statutes Chapter 412 (hereinafter collectively referred to as "City"). <br />. ` The second party to this Agreement is the Lake Johanna Volunteer Fire <br />Departi�ient, Inc., a nonprofit corporation, or anized and operating uncfer the <br />provisions' of Minnesota Statutes Chapter 317 �hereinafter referred to; as <br />"Department"). <br />: SECTION 2 <br />Amendment to Fire Protection Agreement <br />i � . Dated the 3rd Da� of October, 1977 - <br />i � I�n anticipation of the expiration of the five-year contractual term : <br />� 'cov'ered by the Fi�re Protection Agreement dated the 3rd day of_October, : <br />1977 (herein "F,P.A. 10-3-77"), the City and the Department, through their <br />representatives, have met and discussed proposals for continuing a cantrac- <br />� <br />tual relationship for f�re protection services. Except as hereinafter provided <br />or where inconsistent herewith, the te��F.P:A. 10-3-TT shall remain in <br />full force and effect: <br />A. Sectio'n 5 of the F.P.A. 10-3-77 is hereb amended to read: <br />Y <br />SECTION 5 Term <br />� The term of this Agreement shall be for a perioci o# five (5) years <br />commencing'on July T, 1982 and terminat_ing June 30, 1987 unless <br />' termina`ted by mutual consent of the parties or pursuan�t to other : <br />provisions of this Agreement. <br />Negotiations for a continuance of this contract, or a succeedinq - <br />contract shall commence no later than the beginning of the fifth (5th) , <br />_ �year in the term of this contract. - <br />B. Section 19 (G) is hereby added to read: <br />' �� . <br />G. In the event that the Department compensation as:calculated <br />pursuant to Section 19 (C) of the F.P.A. 10-3-77, results in <br />,a compensation increase of less than lOq, a 10;� increase shall <br />: `tie`ap'plied. In the event that the Department campensation <br />as calculated in Section 19 (C) of the F.P.A. 10-3-77,, results <br />, in a compensation increase of more than 15�,, a 15% increase <br />: `shal l be appl ied. <br />_ . <br />
