'It <br /> �-A�EN HILLS <br /> CITY OF ARDEN HILLS <br /> COUNTY OF RAMSEY <br /> STATE OF MINNESOTA <br /> RESOLUTION NO. 2014-040 <br /> ABATEMENT OF A NUISANCE AT 1437 ARDEN PLACE <br /> WHEREAS, Sharon Davies is the property owner of the following described property: <br /> Address: 1437 Arden Place <br /> PID: 343023210016 <br /> Legal Description: Lot 20, Block 1, Arden Hills No. 2. <br /> WHEREAS,the remains of a diseased or dead tree ("Tree") is located on the property; <br /> and, <br /> WHEREAS,this abatement was initiated pursuant to the City of Arden Hills Municipal <br /> Code 710.12 and its subdivisions ("Shade Tree Regulations"),the Tree is declared a public <br /> nuisance; and, <br /> WHEREAS,the property owner has requested that the City remove the Tree and assess <br /> the cost of removal against the property and has agreed to waive any further notices or hearings <br /> which she may otherwise be entitled to pursuant the Shade Tree Regulations; and, <br /> WHEREAS,the property owner has requested that the assessment be deferred as <br /> authorized by Minnesota Statute § 435.193, under terms as specified in the assessment <br /> agreement. <br /> NOW,THEREFORE, BE IT RESOLVED THAT THE ARDEN HILLS CITY <br /> COUNCIL hereby adopts Resolution 2014-040: Ordering Abatement at 1437 Arden Place for a <br /> Public Nuisance Tree, Identified to Have Dutch Elm Disease and Assesses the Property in the <br /> Amount of$3,628.00, Said Amount to be Deferred in Accordance with the Terms of the <br /> Assessment Agreement. <br />
