The temporary and permanent easements for each property are attached as <br />Exhibit C. <br /> <br />7. The City grants the County Temporary Construction Easements over all City owned <br />Rights-of-Way and property within the limits of the Project for use during construction. <br />Any and all billing and fees associated with the project initiated by the City shall be <br />resolved by the City, at no cost to the County. <br /> <br />8. Any Easement that cannot be negotiated will be acquired through eminent domain <br />proceedings. The County will utilize Ramsey County Attorney’s Office, or outside <br />counsel in its sole discretion. <br /> <br />9. The City and County shall each pay 50% of all costs of acquisition of all properties and <br />easements including but not limited to: all court ordered acquisition costs, even if those <br />costs exceed estimates; parcel appraisal costs; acquisition consultants’ fees; relocation <br />costs; site grading, and turf establishment costs; services of the County Attorney’s <br />Office or outside counsel; and any required fees. An invoice from the County to the City <br />for right of way costs will occur after March 15, 2016. <br /> <br />10. At the request of the City, the County will provide periodic updates of the costs of <br />acquisition of Easements, including costs for parcels that have been successfully <br />negotiated and any remaining parcels to be settled. <br /> <br />11. The City shall pay the County a 12% fee for design services and a 12% fee for <br />construction administration of the Project. Design service fees shall be paid before the <br />application of State Funds. Construction administration fees shall be paid at the <br />completion of the Project. The City will pay to the County a 2% fee for construction <br />administration services for betterments requested by the City after the bids are opened <br />the betterments will be designed and inspected by the City, which will be calculated <br />before the application of Federal Funds, if applicable. <br /> <br />12. After the application of State Funds, the costs of storm sewer construction needed for <br />Project drainage (catch basins and leads) will be split in accordance with the drainage <br />area, Exhibit D, incorporated herein by reference. <br /> <br />13. Upon completion of the Project, the County shall own the storm sewer catch basins and <br />leads on County roads and the City shall own and maintain the storm sewer trunk lines <br />within the City. Exhibit E attached, references ownership responsibility of the storm <br />water manholes, catch basins, and piping system. <br /> <br />14. All construction costs related to new water mains, water services, and hydrants shall be <br />paid for by the City. <br />
