ARDEN HILLS CITY COUNCIL – SEPTEMBER 29, 2014 13 <br /> <br />also have frontage on Lake Johanna Boulevard. This is the only alley of this type currently <br />in the City of Arden Hills. <br />20. The proposed building plans for the single-family dwelling would result in a structure that <br />is consistent and compatible with other construction in the area and would not alter the <br />essential character of the neighborhood. <br />21. The requested variance for the single-family dwelling does not appear to be based on <br />economic considerations alone. <br /> <br />Associate Planner Bachler explained that the Planning Commission reviewed this request and <br />unanimously recommends approval (6-0) of Planning Case 14-026 for a variance at 1830 Noble <br />Road to encroach 16.5 feet into the secondary front yard setback, based on the findings of fact and <br />the submitted plans in the September 29, 2014, Report to the City Council, as amended by the <br />following four conditions: <br /> <br />1. The project shall be completed in accordance with the plans submitted as amended by the <br />conditions of approval. Any significant changes to these plans, as determined by the City <br />Planner, shall require review and approval by the Planning Commission and City Council. <br />2. The property owner shall obtain a Grading and Erosion Control Permit from the City <br />before the building permit is issued. <br />3. A building permit and a demolition permit for the construction of the new dwelling and a <br />zoning permit for the construction of the driveway shall be required. <br />4. The structure shall conform to all other regulations in the City Code. <br /> <br />Mayor Grant supported the proposed variance noting that the lot was very unique. <br /> <br />MOTION: Mayor Grant moved and Councilmember Werner seconded a motion to <br />approve Planning Case #14-026 for a variance at 1830 Noble Road to <br />encroach 16.5 feet into the secondary front yard setback, based on the <br />findings of fact and the submitted plans, as amended by the four (4) <br />conditions in the September 29, 2014, report to the City Council. The motion <br />carried (5-0). <br /> <br />9. UNFINISHED BUSINESS <br /> <br />A. Consider Assessment Agreements for Round Lake Road Improvement Project <br /> <br />City Administrator Klaers stated that as provided by state statutes, the City Council met in a <br />closed session prior to the September 29, 2014, regular City Council meeting to discuss litigation <br />regarding the Round Lake Round public improvement assessment appeals. Based on the results <br />of this closed meeting, the general consensus of the Council was to consider taking action on the <br />assessment agreement. <br /> <br />MOTION: Councilmember Holden moved and Councilmember Werner seconded a <br />motion to approve the assessment agreement with CMKR & Holdings. <br /> <br />Councilmember McClung understood the positives to the proposed agreement, however, he <br />stated that he would not be supporting the motion given that the value of this property would be
