Frattallone’s Hardware regularly uses the south and west side of the Arden Plaza retail building <br />for storing pallets of bulk landscaping materials, such as mulch. Based on the definition of <br />exterior storage in the Zoning Code, this use is not permitted in the B-2 District. <br /> <br />An open sales lot is defined as, “any land used or occupied for the purpose of buying and selling <br />any goods, materials, or merchandise, and for the storing of the same under the open sky prior to <br />sale.” This use is specifically prohibited under the special requirements for the B-2 District <br />(Section 1320.085). However, approved open-air garden centers are exempt from this provision <br />and outdoor displays, sales, and storage uses can be permitted by the City Council within a <br />defined garden center. The use of the sidewalk space in front of the store entrance for display of <br />equipment and products is also not allowed, as it would not be within the fenced off garden <br />center. In the past, the City has permitted limited outdoor display areas for businesses such as gas <br />stations or grocery stores. <br /> <br />Staff requests that as part of their consideration of this planning case the City Council address the <br />extent to which exterior storage, displays and sales should be permitted outside of the approved <br />seasonal sales area. Condition #22, as amended by the Planning Commission, has been included <br />in the Report to the City Council, listed under the Recommendation section below. <br /> <br />Another issue raised by the Planning Commission was how the City would ensure that the <br />property owner installs the fence around the seasonal sales area, considering that this <br />improvement was not completed following the previous CUP approval in Planning Case 97-009. <br />Staff has since made minor adjustments to Conditions #11 and #12, which require certain <br />securities for the site improvements, to specify that the installation of the fence is included as one <br />of the required improvements covered by the financial surety. <br /> <br /> <br />Additional Review <br /> <br />City Building Official and City Engineer <br />The Building Official has provided comments included in the attached memo dated January 29, <br />2015. The Planning Commission recommended as a condition of approval that the final plans for <br />the demising wall between Frattallone’s Hardware and the Arden Plaza building meet the <br />standards outlined in this memo. The City Engineer has provided comments included in the <br />attached memo dated January 13, 2015.
