In April 2013, staff was notified by the City Attorney that the development agreements <br />pertaining to Planning Case 09-011, Planning Case 10-008, and Planning Case 11-016 were <br />never properly recorded with Ramsey County. In order to address this issue, staff has been <br />working with the City Attorney and the property owners within Arden Plaza to draft an <br />Amended and Restated Development Agreement that accurately establishes the approvals and <br />conditions for the redevelopment of the three lots on the site. <br /> <br />Discussion <br /> <br />The Amended and Restated Development Agreement includes all previously approved <br />development agreements and amendments and is intended to bring the project current. Going <br />forward it will be the main regulatory document for the properties within the Arden Plaza retail <br />center. The conditions approved in Planning Case 13-010 for the additional signage on the <br />Walgreens building and the Phase II and III Final PUD extensions approved in Planning Case <br />14-018 have been incorporated into the revised document. Several conditions from the <br />previously approved agreements were subsequently satisfied by the property owners and have <br />been removed from the revised agreement. <br /> <br />It should be noted that this document does not include the pending application in Planning Case <br />15-002 for the proposed subdivision, PUD Amendment, and Conditional Use Permit <br />Amendment at Arden Plaza. The City Council voted to table Planning Case 15-002 at their <br />Regular Meeting on February 23, 2015. Any future approvals granted by the City Council <br />regarding Planning Case 15-002 would be included in a separate PUD Amendment Agreement. <br /> <br />The Amended and Restated Development Agreement has been reviewed by the Arden Plaza <br />property owners and they have agreed to the current wording of the document. The City Attorney <br />has completed a property title search to ensure that all relevant entities sign the document. Upon <br />approval by the City Council, staff will circulate the document for signatures from the Arden <br />Plaza property owners. <br /> <br />Requested Action <br /> <br />Motion to approve the Arden Plaza Amended and Restated Master Planned Unit Development <br />Agreement and Phase I Development Contract based on the March 9, 2015, Report to the City <br />Council. <br /> <br />Attachments <br /> <br />A.
