K. Future Improvements/Assessments for the B-2 District Streetscape. The City <br />anticipates constructing streetscape improvements on County Road E, adjacent to Lots 2 and 3. Arden <br />Plaza hereby agrees to waive its right to appeal any special assessments levied against Lots 2 or 3 for <br />streetscape improvements, associated with the implementation of the Guiding Plan for the B-2 District, <br />provided that: <br />1. Such special assessment does not exceed an amount equal to $350 per lineal <br />foot on County Road E; <br />2. The property within the Plat that is subject to the terms of this Restated <br />Agreement is specially assessed in the same manner as other similarly situated properties; <br />L. Arden Plaza shall convey temporary construction easements over Lots 2 and 3 to <br />the City for implementing the County Road E streetscape improvements. The City shall reasonably <br />restore the area of the temporary construction easement to its condition prior to construction of the <br />streetscape improvements. <br />3. FINAL PLAT. <br />A. Arden Plaza shall submit an agreement for shared management and maintenance of <br />the parking areas, landscaping features, stormwater facilities, and common areas. The agreement shall be <br />subject to City Attorney approval prior to the issuance of any building permits. <br />4. DEVELOPMENT CONTRACT-PHASE I. <br />A. The City currently holds $15,839.25 in escrow for remaining landscaping <br />improvements on Lot 1. The City will maintain the escrow until a final landscape inspection has been <br />completed in August 2014. <br />B. Wall signage for the building located on Lot 1 shall consist of no more than 156.4 <br />square feet.
