the Property into two separate lots for the purpose of selling Lot 2, comprising approximately <br />15.6 acres, to reflect changes in the property boundaries as a result of the subdivision, to update <br />the Campus Master Plan, and to create a separate Planned Unit Development for each new Lot. <br /> <br />3. PLANNING COMMISSION REVIEW. On February 4, 2015, the City Planning <br />Commission reviewed the application at a public hearing and after considering the application, <br />the reports and comments of the City’s staff, the reports and comments of Boston Scientific, and <br />other public comments, and subject to conditions, recommended approval of the 12th <br />Amendment to the Master Planned Unit Development Agreement. <br /> <br />4. CITY COUNCIL REVIEW. On February 23, 2015, the City Council reviewed the <br />application, the reports and recommendations of City’s staff, the reports of Boston Scientific, and <br />the recommendations of the City Planning Commission, and has approved the 12th Amendment <br />to Master Planned Unit Development Agreement, all subject to the terms and conditions herein <br />contained. <br /> <br />5. TERMS AND CONDITIONS. <br /> <br /> A. The project shall be completed in accordance with the plans attached hereto as <br />Exhibit A. Any significant changes to these plans, as determined by the City Planner, shall <br />require review and approval by the Planning Commission and City Council. <br /> <br /> B. The current and subsequent owners of Lot 1 and Lot 2 shall continue to abide by <br />the conditions of all previous Development Agreements, Master PUD approvals, and subsequent <br />PUD Amendment approvals: subsequent PUD amendments, however, will be applied for, <br />processed and approved separately for the two Lots. <br /> <br />C. A PUD Amendment drafted by the City Attorney shall be executed prior to the <br />execution of the Final Plat. <br /> <br /> D. The PUD Amendment and Site Plan Review shall automatically expire and <br />become void one (1) year after the date on which the Council granted approval if work on the <br />project has not begun. <br /> <br /> E. Prior to the City signing the Final Plat, Boston Scientific will provide a Shared <br />Management and Maintenance Agreement for a stormwater pond that spans Lots 1 and 2, which <br />agreement must be reviewed and approved by the City Attorney. <br /> <br />F. A Site Plan Review application, including a Landscaping Plan, is required for the <br />modification of the parking area along the Lot 1 and Lot 2 property boundary line and shall be <br />submitted prior to March 1, 2016, or an extension request shall be submitted in writing to the <br />City at least forty-five (45) days prior to that date. <br /> <br />G. All necessary City permits for the removal of the existing skyway structure <br />connecting Building B and Building E as depicted on the current Campus Master Plan shall be <br />2 <br />180589v5
