of the CUP Amendment the City Council address the extent to which exterior storage, displays <br />and sales should be permitted on the property. Condition #13, as amended by the Planning <br />Commission, has been included in the Report to the City Council, listed under the <br />Recommendation section below. <br /> <br />The special requirements for the B-2 District prohibit open sales lots, which are defined as “any <br />land used or occupied for the purpose of buying and selling any goods, materials, or <br />merchandise, and for the storing of the same under the open sky prior to sale.” However, <br />approved open-air garden centers are specifically exempt from this provision and outdoor <br />displays, sales, and storage uses can be permitted by the City Council within a defined garden <br />center. The existing garden center currently operates with a CUP under this exception. The <br />Garden Center Exhibit included in Attachment D depicts those areas on the property where <br />outdoor displays and storage associated with the open-air garden center are proposed. <br /> <br />If the CUP Amendment is approved, the Garden Center Exhibit would act as a regulating <br />document for the conditional use on the property. Staff is recommending as a condition of <br />approval that the site be maintained and the business operated per the requirements depicted in <br />the Garden Center Exhibit. This condition is listed as #14 under the Recommendations section <br />below. <br /> <br />One item raised by the City Council at the Work Session on March 16, 2015 was the need for <br />additional screening of the storage area along the south side of the retail center building. Staff <br />has discussed with the applicant whether fencing and gates could be installed along the perimeter <br />of the defined storage area. This could present operational challenges to the business and would <br />require a significant financial investment. As a compromise, staff is recommending condition <br />#15, which would require a financial commitment of up to $20,000 from Frattallone’s Ace <br />Hardware to install additional landscaping or screening along the south and west side of the <br />property if after two full years of operations it was determined by the City that the storage on the <br />south side of the building was creating a negative impact on neighboring properties. <br /> <br /> <br />Additional Review <br /> <br />Lake Johanna Fire Department <br />The Lake Johanna Fire Marshall has reviewed the plans and noted that no storage of hazardous <br />materials will be permitted within the storage area along the south side of the Frattallone’s <br />Hardware building and that no storage will be allowed to block egress doors. <br /> <br />City Engineer <br />The City Engineer has reviewed the construction plans for the outdoor seasonal sales area and <br />has determined that a Grading and Erosion Control Permit will be required. <br /> <br /> <br />Findings of Fact <br /> <br /> <br />City of Arden Hills <br />City Council Meeting for April 13, 2015 <br />P:\Planning\Planning Cases\2015\PC 15-002 - Arden Plaza - Master PUD Amendment and Subdivision\Memos_15-002 <br />Page 5 of 9
