• CITY OF ARDEN HILLS <br /> MEMORANDUM <br /> DATE: March 30, 2001 <br /> TO: Mayor and City Council <br /> FROM: Jennifer Chaput, City Planner( <br /> SUBJECT: Right of Way Ordinance VV <br /> Planning Case #00-39, City of Arden Hills <br /> Request <br /> The City of Arden Hills requests review of a model right-of-way ordinance at the April 30, 2001 <br /> City Council meeting and a public hearing and adoption at the May 14, 2001 City Council meeting. <br /> Background <br /> The model right-of-way ordinance,provided by the North Suburban Communications Commission <br /> • (NSCC), was presented to the Planning Commission at their November and December,2000 regular <br /> meetings for review. The Planning Commission reviewed a model right-of-way ordinance that was <br /> provided by the North Suburban Communications Commission(NSCC),the result of a cooperative <br /> effort between the City Engineer Association of Minnesota and the League of Minnesota Cities and <br /> thoroughly reviewed by an attorney for the North Suburban Communications Commission. The <br /> Planning Commission did not feel that this Ordinance was within their area of expertise and referred <br /> the Ordinance to the City Council for review, without recommendations. <br /> The purpose of the model ordinance is to give cities a uniform set of regulations to help them govern <br /> the use of their rights-of-way. It is intended to provide a single set of regulations that cities can apply <br /> to all right-of-way users, including telecommunications companies. In particular, the Ordinance <br /> implements a city's authority to manage its right-of-ways and to recover its actual costs incurred in <br /> managing excavations and/or obstructions within the right of way, a basic and necessary requirement <br /> of the City. <br /> Recommendations <br /> Staff recommends that the proposed Right of Way Ordinance be presented to the City Council at the <br /> April 30, 2001 City Council meeting for a "first read". If acceptable at that time, a public hearing <br /> will be held at the following City Council meeting(May 14, 2001) for final review and adoption of <br /> the Ordinance. <br /> • <br />
