ARDEN HILLS PLANNING COMMISSION—APRIL 4, 2001 9 <br /> The land surveyor also pointed out that the plat did not show or dedicate the Ponding and Utility <br /> Easement that was created in 1998 for the pond located in the northwest corner of the plat. Staff <br /> researched this issue and found that that City did not complete the filing procedures for the <br /> easement when the Welsh Development was completed. Therefore, the City would need to <br /> complete this procedure for it to show up on the plat. This would be best done during the time <br /> when the applicant returned to the City with a preliminary plat to consolidate all parcels for <br /> development. Otherwise, the Ponding and Utility Easement would need to be going through the <br /> same vacation and dedication procedures as the road easements were currently. <br /> The land surveyor also asked if the sixty-foot right-of-way for Gateway Boulevard would be <br /> sufficient for the area development. The City Engineer stated that the right-of-way might need to <br /> be expanded, depending on the location of the trail dedication, at the time of development. This <br /> was not an issue that needed to be dealt with at this time, but when the applicant returned for <br /> preliminary platting (consolidating) of all of the properties pertaining to the proposed <br /> development. <br /> Ms. Chaput stated the final plat and vacation of easements had also been thoroughly discussed <br /> with the City Attorney who had not identified any particular issues at this time. <br /> Ms. Chaput presented the Commission's options for consideration of this application and advised <br /> that Staff recommended approval of Planning Case #01-09, final plat of the property located in the <br /> Northeast quadrant of I-694 and I-35W, with six conditions as outlined in the staff report. <br /> Chair Baker closed the public hearing at 8:46 p.m. <br /> Commissioner Duchenes asked if there should be some memorialization of this in the land <br /> documents filed. Ms. Chaput stated she would check with the City Attorney regarding this. <br /> Commissioner Duchenes moved, seconded by Commissioner Zimmerman, to recommend <br /> approval of Planning Case #01-09, Chesapeake Companies, I-35W and I-694, Northeast <br /> Quadrant, Final Plat/Vacation of Easement, based on the following findings: <br /> 1. Dedication or conveyance of the storm water pond easement over Lot 1, Block 1 by the <br /> applicant; <br /> 2. Land dedication to the City as a requirement of the platting process will be addressed when <br /> the properties are being replatted at the final PUD stage; <br /> 3. Blocks 1, 2 and 3 of Lot 1 will not be developed separately as it is the understanding of the <br /> City that all parcels will be consolidated through an additional platting process, and this be <br /> memorialized in the real estate record along with the recording of the plat; <br /> 4. The final plat must be recorded with the County within sixty (60) days after the date of <br /> approval, otherwise it shall be considered void; <br /> 5. Following recording, the applicant shall provide the City with a tracing and three (3) prints <br /> of the final plat, showing evidence of the recording. <br /> 6. Land ties at any MnDOT monuments located in the field should be shown on the plat. <br /> The motion carried unanimously(7-0). <br />
