<br />City of Arden Hills <br />City Council Meeting for July 27, 2015 <br />P:\Planning\Planning Cases\2015\PC 15-014 - Verizon Wireless CUP - 2 Pine Tree Drive\Memos_Reports_15-014 <br />Page 2 of 5 <br />The City previously approved a CUP in 2009 allowing for the installation of a roof-mounted <br />monopole and antennas for Clearwire Wireless at 2 Pine Tree Drive (PC #09-020). The existing <br />monopole extends 13 feet above the roofline of the penthouse. The Zoning Code requires a CUP <br />for all new antenna installations in the City and that these uses be accessory to an existing <br />principal use on the property. The proposed antennas would be an accessory use to the principal <br />higher education and office uses at 2 Pine Tree Drive. <br /> <br /> <br />Plan Evaluation <br /> <br />A full evaluation of the proposal was presented to the Planning Commission at their July 8, 2015, <br />Regular Meeting. The staff report to the Planning Commission on this case is included in <br />Attachment F. The proposed antenna installation meets the height, location, and screening <br />requirements included in Section 1325.09 of the Zoning Code, which regulates antennas, dish <br />antennas, and towers in the City. <br /> <br />At the Planning Commission meeting, Council Liaison Woodburn raised the question of whether <br />the proposed antennas should be considered an accessory use under the definition provided in the <br />Zoning Code. Staff has discussed this with the City Attorney who agrees with the staff <br />conclusion that based on the provisions within the Zoning Code the antennas would be an <br />accessory use to the principal higher education and office uses on the property. <br /> <br /> <br />Conditional Use Permit Review <br /> <br />Section 1355.04 Subd 3 of the Arden Hills Zoning Code lists the criteria for evaluating a <br />Conditional Use Permit. The City Council should consider the effect of the proposed use upon <br />the health, safety, convenience and general welfare of the owners and occupants of the <br />surrounding land, in particular, and the community as a whole, in general, including but not <br />limited to the following factors: <br /> <br />1. Existing and anticipated traffic and parking conditions; <br />2. Noise, glare, odors, vibration, smoke, dust, air pollution, heat, liquid or solid waste, and <br />other nuisance characteristics; <br />3. Drainage; <br />4. Population density; <br />5. Visual and land use compatibility with uses and structures on surrounding land; adjoining <br />land values; <br />6. Park dedications where applicable; and the <br />7. Orderly development of the neighborhood and the City within the general purpose and <br />intent of this ordinance and the Comprehensive Development Plan for the City. <br /> <br /> <br />
