Page 1 of 1 <br /> <br />DATE: July 27, 2015 <br /> <br />TO: Honorable Mayor and City Councilmembers <br />Patrick Klaers, City Administrator <br /> <br />FROM: John Anderson, Assistant City Engineer <br /> <br />SUBJECT: Site Use Lease Agreement with New Cingular Wireless PCS, LLC, fka AT&T <br /> <br /> <br />Requested Action <br /> <br />Approve the Site Use Lease Amendment No. 1 with New Cingular Wireless PCS, LLC for the <br />lease of City property located at 1221 Cummings Park Drive. <br /> <br />Background/Discussion <br /> <br />AT&T currently leases space at the Cummings Park Drive water tower and has installed three <br />antennas at 130 feet (the top of the tower), three antennas at 80 feet, and an equipment shelter on <br />the ground. AT&T is proposing to build an addition to their ground leased area to house a <br />generator to supply emergency power to their equipment on site. The work would involve <br />extending a concrete slab to the east of their existing building and replacing all of their fencing <br />with a wooden privacy fence. Their on ground facility is located inside the driveway loop at the <br />site. The other carrier that leases space on the ground at the site is T-Mobile. <br /> <br />The current City lease (renegotiated and approved in 2014) with AT&T for this site has an <br />annual lease payment of $34,320 which will increase by 4% annually. The lease amendment <br />proposed, would increase the annual payment by $4,800 and this increase would also increase <br />annually by the 4% annual rate increase. <br /> <br />The City Attorney has reviewed the terms of this lease amendment. <br /> <br />Attachments <br /> <br /> First Amendment to Site Use Lease Agreement <br /> <br />CONSENT ITEM - 5C <br /> <br /> MEMORANDUM <br />
