The accent lights would create glare that would have a negative impact for those <br />travelling along Highway 96 and Round Lake Road, as well as for residents in the Arden <br />Manor manufactured home park and residents on the east side of Round Lake <br />9. The proposed accents lights would be in conformance with the other requirements <br />regarding exterior lighting within Section 1320.13 and Section 1325.05, Subd. 3 of the <br />Zoning Code. <br />10. The proposal will not impact existing and anticipated traffic and parking conditions. <br />11. The proposal will not affect noise, odors, vibration, smoke, dust, air pollution, heat, liquid <br />and solid waste on the property. <br />12. The proposed lighting would create glare visible from adjoining public streets and <br />residential areas to the east and north of the property. <br />13. The proposal will not affect drainage on the property. <br />14. The proposal will not affect the population density on the property. <br />15. The proposal is unlikely to significantly affect land values on the subject property or on <br />neighboring properties. <br />16. The park dedication requirement does not apply in this case. <br />17. Where the proposal is not in conformance with the Zoning Code and Sign Code the <br />applicant has requested flexibility through the PUD process. <br />18. Based on the submitted plans and evaluation included in the staff report to the Planning <br />Commission, the flexibility being requested through the PUD process would not be in the <br />overall best interest of the community. <br /> <br />Associate Planner Bachler discussed a letter received by staff on May 5, 2015, from East <br />Round Lake residents and property owners expressing concern and opposition to the proposed <br />accent lighting. <br /> <br />Associate Planner Bachler stated that based on the submitted plans and findings of fact, staff <br />recommends denial of Planning Case 15-008 for a Planned Unit Development (PUD) <br />Amendment for the addition of architectural accent lighting along the top of the canopy and the <br />roofline of the building at the Holiday service station at 1920 West Highway 96. If the Planning <br />Commission makes a motion to approve Planning Case 15-008, the findings of fact would need <br />to be amended to reflect the reasoning for their decision. Staff is recommending that the Planning <br />Commission consider including the following four (4) conditions if a motion to approve is made: <br /> <br />1. The project shall be completed in accordance with the plans submitted as amended by the <br />conditions of approval. Any significant changes to these plans, as determined by the City <br />Planner, shall require review and approval by the Planning Commission and City <br />Council. <br />2. A PUD Amendment Agreement shall be drafted by the City Attorney and shall be <br />executed prior to the issuance of an Electrical Permit for the installation of the LED <br />accent lights. <br />3. An automatic dimmer module shall be installed to reduce the nighttime light output of the <br />LED accent lights on the canopy and building to sixty percent (60%) of the daytime level. <br />4. An automatic dimmer module shall be installed on the existing monument sign on the <br />property to reduce the nighttime light output of the LED lights on the sign to sixty percent <br />(60%) of the daytime level. <br />
