It <br /> �I <br /> CITY OF ARDEN HILLS <br /> MEMORANDUM <br /> DATE: May 24, 2001 <br /> TO: Mayor Probst and Councilmembers <br /> FROM: Joe Lynch, City Administrator <br /> SUBJECT: West Round Lake Road Trail,400ltt Company Easement <br /> Background <br /> As earlier indicated in a previous non-agenda item,Nott Company has worked closely with the <br /> City on the conversion of a utility and drainage easement description and a relocation of the trail <br /> easement within the converted utility and drainage easement in order to allow the West Round <br /> Lake Road trail to connect up to Highway 96. <br /> At this time,they are requesting reimbursement for legal expenses, not to exceed$1,800.00 for <br /> the work that their attorney did aA in meeting with our engineer and attorney to change the legal <br /> descriptions of the utility and drainage easement,as well as the park trail easement. Payment of <br /> legal expenses would not,therefore,be payment for acquisition of the property for the easement. <br /> Recommendation <br /> I would recommend that the City Council approve payment of legal expenses to Nott Company, <br /> not to exceed$1,800.00 so that we may complete the acquisition of the trail easement, and move <br /> on and meet with the owners of AMB at 4364 West Round Lake Road, Grainger and Scholl's <br /> buildings to complete the trail easement. <br />
