,-A EN HILLS <br /> MEMORANDUM <br /> TO: Mayor and City Council <br /> FROM: Joe Lynch, City Administrato <br /> SUBJECT: Right-of-Way Ordinance <br /> Planning Case 00-39 <br /> DATE: June 7, 2001 <br /> Staff requests the City of Arden Hills review a Right-of-Way ordinance at the public hearing at <br /> the June 11, 2001, City Council meeting. This follow up from the first review of the ordinance <br /> at the April 30, 2001, City Council meeting. <br /> Background <br /> The Right-of-Way ordinance which was provided by the North Suburban Communications <br /> Commission(NSCC)was presented to the Planning Commission at their November and <br /> December 2000 regular meetings for review. The Planning Commission did not feel this <br /> ordinance was within their area of expertise and referred the ordinance to the City Council for <br /> their review without recommendations. <br /> The ordinance is designed to give cities an uniform set of regulations to help them govern the use <br /> of their right-of-ways. It provides a single set of regulations that cities can apply to all right-of— <br /> way users including telecommunications and utilities companies. The ordinance implements the <br /> city's authority to manage it's right-of-way and to recover the actual costs incurred in managing <br /> excavations or obstructions within the right-of-way. <br /> Recommendation <br /> Staff recommends that the proposed Right-of-Way ordinance be adopted. The ordinance has <br /> been changed to reflect those items previously identified by the City Engineer and the former <br /> Public Works Director. Staff recommends that the Council direct that a summary ordinance be <br /> published and the ordinance be number coded in compliance with our new city code. <br /> Enclosed is the copy of affidavit to publication providing proof that proper notification was <br /> given in the time frame met for publication. <br />
