utility, a successor or assign of any of the foregoing, or any <br /> other legal entity which has or seeks to have equipment in any <br /> right-of-way. <br /> 27 . "Probation" means the status of a person that has not complied <br /> with the conditions of this chapter. <br /> 28 . "Probationary Period" means one year from the date that a <br /> person has been notified in writing that they have been put on <br /> probation. <br /> 29 . "Registrant" means any person who (1) has or seeks to have its <br /> equipment located in any right-of-way, or (2) in any way <br /> occupies or uses, or seeks to occupy or use, the right-of-way <br /> or any equipment in the right-of-way. <br /> 30 . "Repair" means the temporary construction work necessary to <br /> make the right-of-way usable for travel . <br /> 31 . "Restore or Restoration" means the process by which an <br /> excavated right-of-way and surrounding area, including <br /> pavement and foundation, is returned to the same condition <br /> that existed before the commencement of the work. <br /> 32 . "Restoration Cost" means an amount of money paid to the City <br /> by a Permittee to cover the cost of restoration. <br /> 33 . "Right of Way" means the surface and space above and below a <br /> public roadway, highway, street, cartway, bicycle lane and <br /> public sidewalk in which the City has an interest, including <br /> other dedicated rights-of-way for travel purposes and utility <br /> easements of the City. <br /> 34 . "Right-of-Way Permit" means either the Excavation Permit or <br /> the Obstruction Permit, or both, depending on the context, <br /> required by this chapter. <br /> 35 . "Service" or "Utility Service" includes but is not limited to <br /> (1) those services provided by a public utility as defined in <br /> Minn. Stat . §216B. 02, Subds . 4 and 6; (2) telecommunications, <br /> pipeline, community antenna television, fire and alarm <br /> communications, water, electricity, light, heat, cooling <br /> 6 <br />
