Upon application for a
waiver and notification to all properties within 500 feet from the property line at least ten days
prior to the City Council meeting, the City Council may grant a permit waiving the requirements
of this Section for maintenance activities and may impose reasonable conditions to it.

Park Construction, the County Road E contractor, has applied for a waiver to perform night time
work on Monday August 31 through Friday (until Saturday morning) September 4. Their plan is
to schedule the work for Monday and Tuesday with the remainder of the week as a backup if
weather requires the work to be postponed. The milling and paving would begin late in the
evening and run into the morning hours (approximately 9:00 or 10:00 a.m.). Park Construction’s
application is attached. Also attached is the letter City staff sent to properties within 500 feet of
County Road E as required by the Ordinance. Finally, attached is a map showing the properties
that were notified.

As of the preparation of this memo, the only property City staff has heard from was Bethel
University who had some clarifying questions but has no problem with the request.

Attachments

Attachment A: Night Time Construction Activity Waiver
Attachment B: Letter of notification to surrounding properties
Attachment C: Map of properties notified
