City Engineer <br />The City Engineer reviewed the proposal and stated that a Grading and Erosion Control <br />Permit is required for this project. <br /> <br />C. Rice Creek Watershed District <br />The Rice Creek Watershed District (RCWD) has indicated that a permit is not required <br />for projects that involve a land disturbance of less than 10,000 square feet. The total <br />area of disturbance is estimated at 4,000 square feet. <br /> <br /> <br />Findings of Fact <br /> <br />The Planning Commission reviewed Planning Case 15-018 at their regular meeting on <br />September 9, 2015. Draft minutes from the meeting are included in Attachment A. The <br />Planning Commission offers the following fourteen (14) findings of fact for consideration: <br /> <br />1. The lot meets the minimum requirements of the R-1 Zoning District. <br />2. The existing dwelling does not encroach on any setbacks requirements. <br />3. A Site Plan Review is required for the detached accessory structure to exceed 728 square <br />feet. <br />4. Garages and accessor y structures are permitted within the R-1 Zoning District. <br />5. The proposed structure coverage meets the requirements of the R-1 Zoning District. <br />6. The minimum landscaped area exceeds the requirements of the R-1 Zoning District. <br />7. The existing dwelling does not exceed the 35 foot height limit. <br />8. The proposed accessory structure would not exceed the 15 foot height limit for accessory <br />structures. <br />9. The driveway would be expanded to provide access to the new structure. <br />10. The existing dwelling and the proposed garage are outside of the 100-year flood plain, <br />wetlands, and easements. <br />11. The proposed accessory structure would be 864 square feet in size. <br />12. The exterior finish will match or complement the principal structure. <br />13. The lot is unusual in that it is unusually large, and there would be enough room to <br />construct two (2) 728 square foot accessory structures on the property without a Variance <br />or Site Plan Review. <br />14. The proposed accessory structure would create less impact and be more attractive than <br />having two (2) accessory structures on the property. <br /> <br /> <br />Recommendation <br /> <br />The findings of fact for the Site Plan Review support approval. However, if the City Council <br />chooses to deny the application, the findings of fact would need to be amended to reflect the <br />reasons for the denial.
