AGENDA ITEM – 1C <br /> <br />MEMORANDUM <br /> <br />DATE: October 19, 2015 <br /> <br /> <br />TO: Honorable Mayor and City Council Members <br /> <br />FROM: Sue Iverson, Acting City Administrator <br /> Director of Finance and Administrative Services <br /> <br />SUBJECT: Council Vacancy Discussion <br /> <br /> <br />Background <br /> <br />Due to the unexpected passing of Councilmember Robert Woodburn on October 2, 2015, <br />a vacancy now exists on the City Council. This vacancy will need to be filled by Council <br />appointment until an election is held. Since more than two years remain in the unexpired <br />term, a special election will be held at the next regular City election. The appointed <br />person shall serve until the qualification of a successor is elected at a special election to <br />fill the unexpired portion of the term. <br /> <br />Discussion <br /> <br />The City Council adopted a resolution declaring the vacancy which also indicated that we <br />will hold the special election next November. Staff has been in contact with both <br />Ramsey County and the City Attorney in order to insure that we file the proper <br />paperwork and notices. <br /> <br />Some items to note while we have a declared vacancy: <br /> Items that need a 4/5 vote of the City Council will now only require a 3/4 vote <br />until someone is appointed. <br /> Regular items still need a 3/4 vote. <br /> Special Mayoral authority is limited to the vacancy issue in that if there is a 2-2 <br />vote, the Mayor makes the appointment. This is per M.S. 412.02. <br /> <br />Council Action <br /> <br />The City Council will need to determine how they wish to proceed with appointing <br />someone to this vacancy until a special election is held. <br />
