� T <br /> drive-up windows due to their impact on traffic flow,pedestrians, and building design; however, <br /> the intent does not completely match the wording in the provisions. <br /> In order to clarify the intent of the existing regulations, staff is proposing to add a definition for <br /> "drive-up windows"and extend the regulations for drive-in businesses and fast food restaurants <br /> to drive-up windows. For the time-being, this will only apply to the B2 District, but staff plans <br /> on preparing an overall fix for the other zones as soon as December. Due to public notice <br /> requirements, the current public notice for the B2 design standards does not extend to modifying <br /> regulations for the other zoning districts. However, because of the sensitivity of the B2 District, <br /> staff wanted to makes sure that the B2 District regulations were clearer. <br /> 1320—District Provisions <br /> The District Provisions chapter includes the purpose, setbacks, coverage regulations, and uses <br /> that pertain to each particular zoning district. Some zoning districts have additional special <br /> requirements that need to be met, which may include design standards that pertain to just that <br /> particular district. The special requirements for the B2 District start in section 1320.085 <br /> (Attachment B). <br /> In late 2007, the City did adopt some basic design standards for the B2 District. As part of these <br /> proposed amendments, staff is proposing to delete most of the existing design standards listed in <br /> 1320.085 and move them to a new subdivision eight in section 1325.05. We are proposing this <br /> move because it will be easier and cleaner to extend these new design standards to other zoning <br /> districts with similar intents and purposes. Staff is tentatively planning on extending these <br /> • regulations to the B-3 and potentially the B-4 zoning districts. By placing these regulations in <br /> section 1325.05 Subd 8, they will not need to be repeated again and again in section 1320 for <br /> each district. <br /> 1320.04 Subd %—Purpose <br /> The B2 District purpose was revised to better reflect the vision statement and planning and <br /> design principles on pages 1 and 2 of Chapter 5 of the "Guiding Plan for the B2 District." <br /> While the purpose may seem to be generalized, it is an important part of all zoning codes <br /> because it sets the stage for why a city is adopting a particular set of regulations. Cities can <br /> have quite a bit of leeway for adopting design and zoning regulations provided they are done <br /> so for a reason with an understandable and reasonable purpose. <br /> 1320.05—Land Use Chart <br /> The land use chart lists the permitted and conditional uses in all districts. A few uses can be <br /> approved only through a planned unit development (PUD). Many of the uses have <br /> definitions in Section 1305.04. If a use is not listed, it is automatically prohibited.
