} <br /> The DNR has started an update process to the statewide shoreland regulations,which is the <br /> foundation for shoreland regulations in virtually all cities. Based on conversations with the <br /> DNR, any draft rules would not be available until at least April 2009 and that final updates could • <br /> still be a number of years away pending state approval. In the interim,the DNR recommended <br /> Staff review the alternative shoreland management standards that were published in December <br /> 2005, though those standards are more suited to undeveloped areas. While future changes to the <br /> statewide regulations may impact the City's ordinance, Staff recommends moving forward with <br /> our update process so that local needs can be addressed. <br /> Identified Issues <br /> As part of this update project, Staff has identified a number of open issues and concerns. While <br /> some of these concerns can be addressed with existing DNR regulations and guidelines, others <br /> do not have official guidance from the DNR or are not adequately addressed by the DNR. Staff <br /> has gathered a considerable amount of research. In addition to consulting with neighboring <br /> communities as well as the City of Minnetonka and the City of Eden Prairie, Staff worked with <br /> the DNR, the City Attorney, and residents to shape the attached draft of the ordinance. <br /> The attached draft and items highlighted for specific discussion are not considered final, and <br /> Staff encourages additional questions and suggestions. <br /> NOTE: The attached draft is in black-lined form and Staff has highlighted areas that specifically <br /> require additional discussion; however the entire document is open for change, feedback, and <br /> discussion as well. • <br /> Definitions <br /> Pages from Section 1305 have been included in this packet (Attachment A). These are the <br /> definitions that are proposed to be added or amended with the adoption of the Shoreland <br /> Management Ordinance. Most of the changes come directly from the DNR regulations and are <br /> required to be changed to bring the City regulations into compliance with the DNR. A number <br /> of definitions have been deleted that are not reference in the City's ordinance as well. <br /> Shoreland Regulations (Attachment#J <br /> Section 1330 has been included in its entirety. This section of the City Code is the most <br /> significantly altered by this proposed amendment. Parts of this section have been updated to <br /> reflect current DNR regulations, other parts have been amended to better clarify current <br /> enforcement practice in the Shoreland area, and still other areas have been added to reflect <br /> growing concern amongst City Council and other residents about issue facing the shoreland. <br /> Below is a list of significant changes to the regulations.
