Page 1 of 3 <br /> <br />DATE: November 16, 2015 <br /> <br />TO: Honorable Mayor and City Councilmembers <br />Sue Iverson, Acting City Administrator <br /> <br />FROM: Jill Hutmacher, Community Development Director <br /> <br />SUBJECT: Draft Public Use Dedication Ordinance <br /> <br /> <br /> <br />Requested Action <br /> <br />The City Council is requested to review and provide comment on draft Ordinance 2015-006 <br />which revises Section 1130.08 (Public Use Dedications) of the City Code. <br /> <br />Summary <br /> <br />City staff has been working with the City Attorney to update and revise the City’s park <br />dedication ordinance in order to: <br /> Clarify requirements for park dedication throughout the City; <br /> Affirm park dedication requirements for redevelopment or reuse projects; <br /> Ensure that sufficient resources will be available for park development at TCAAP. <br /> <br />The revised park dedication ordinance includes two requirements for subdivision or development <br />approval – a land dedication requirement and a park development fee. The land dedication <br />requirement enables the City to acquire land for park, trail, and open space purposes. The park <br />development fee allows the City to collect fees for park development and capital improvements. <br /> <br />At its discretion, the City may require subdividers or developers to satisfy the land dedication <br />requirement or the park development fee or both. In redevelopment or reuse scenarios, the City <br />may consider whether adequate land was conveyed or dedicated to the City at the time of <br />previous development to meet the park and open space needs. If the City determ ines that <br />adequate land was previously dedicated, the City could waive the land dedication requirement, <br />but apply the park development fee to support capital improvements to the parks, trails, and open <br />space system. <br /> <br /> <br /> <br />AGENDA ITEM – 1A <br /> <br /> <br />MEMORANDUM <br />
